ORDINANCE N0. ~4 17
AN ORDINANCE AMENDING CHAPTER 12, ARTICLE 3, HAWAII COUNTY CODE 1983,
RELATING TO IMPROVEMENTS BY ASSESSMENTS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 12, Article 3, Section 12-34(a), Hawaii
County Code 1983, is amended to read as follows:
"(a) In case of an election to pay any assessment in
installments, the assessment shall oe payaole in not less than five
nor more than twenty annual installments of principal, provided that
the council may, in its discretion, determine the date on which
payment of such annual installments shall commence, which date shall
oe no more than three years from the thirty-first day following the
last puolication of the ordinance required to oe enacted pursuant to
section 12-29. The annual installments shall oe in such amounts as
determined oy the council, and each annual installment may oe made
payaole in twelve equal monthly installments; provided that
principal, interest or ooth on any ponds outstanding due prior to
collection of annual assessment shall oe paid in accordance with
section 12-49, and except as provided in sections 12-44, 12-45, and
12-46 regarding temporary advances, shall not oe paid out of any
moneys availaole in the County treasury. Interest in all cases
shall oe paid on the unpaid principal, at [a] such rate [not
exceeding eight percent per annum] or rates as may oe determined oy
the council."
SECTION 2. Material to oe repealed is oracketed. New
material is underscored. In printing this ordinance, the oracketed
material or the underscoring need not oe included.
SECTION 3. This ordinance shall take effect upon its
approval.
