ORDINANCE N0. 84 ~~
AN ORDINANCE AMENDING ARTICLE 8 OF CHAPTER 14 OF THE HAWAII COUNTY
CODE, AS AMENDED, RELATING TO NUCLEAR ENERGY, BY ADDING A NEW
SECTION ESTABLISHING EXEMPTIONS TO ARTICLE 8.
8E IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 14-44, of the Hawaii County Code relating to
the purpose of Article 8, Chapter 14, Nuclear Energy, is amended by
adding the following paragraph:
"The purpose of Article 8 shall not in any way inhibit or
prohibit the military from carrying out their duties and
responsibilities."
SECTION 2. Article 8, Chapter 14, of the Hawaii County Code, as
amended, is hereby amended by adding the following new section to be
properly numbered by the Corporation Counsel.
"Section Exemptions. This Article shall not apply
to militar vehicles includin shi s equipment and ordnance
u i ized y the armed orces in carrying ou eir du ies an
responsibilities.
SECTION 3. Material to be repealed is bracketed. New material
is underscored. In printing this ordinance, the brackets, bracketed
material, and underscoring need not be included.
SECTION 4. In the event that any portion of the ordinance is
declared invalid, such invalidity shall not affect the other parts
of this ordinance.
SECTION 5. This ordinance shall take effect upon its ap~ al.
