AN ORDINANCE AMENDING SECTION 25-251, ARTICLE 21, CHAPTER 25 (ZONING
CODE;, OF THE HAWAII COUNTY CODE 1983, AS AMENDED, RELATING TO
PLANNED UNIT DEVELOPMENT.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The Council finds that the purpose of a
planned unit development (P. U. D.) is to encourage comprehensive
site planning which maximizes the development of our lands by
allowing diversification in the relationships of various uses,
buildings, structures, open spaces and yards, building heights, and
lot sizes in planned building groups.
The Council also believes that well-planned developments will
allow for building heights to exceed the designated height limits
specified under the zoned district without causing any adverse
effects upon adjacent and surrounding existing or prospective
development.
SECTION 2. Section 25-251, Article 21, Chapter 25, of the
Hawaii County Code 1983 is amended by adding the following
subsections to read as follows:
"(b) A building proposed under a P. U. D. may exceed the height
limit specified under the zoned district of the property and from
the requirements of section 25-56 of this division. However, the
maximum height of the building shall not exceed 75 feet.
(c) A building proposed under a P. U. D. and situated within
a zoned district which exceeds the height limits specified within
this section may be permitted at the higher height limit specified
under regulations for that zoned district."
SECTION 3. In the event that any portion of the ordinance is
declared invalid, such invalidity shall not affect the other parts
of this ordinance.
SECTION 4. This ordinance shall take effect .upon its approval.
