S 4 6E AN ORDINANCE A[4ENDING SECTION 25-212, ARTICLE 15 AND SECTION 25-220, ARTICLE 16, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE 1983, AS AMENDED, RELATING TO MINIMUM YARD REQUIREMENTS WITHIN THE GENERAL AND LIMITED INDUSTRIAL ZONED DISTRICTS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The Council finds that industrial buildings are normally constructed with firewalls. The Council feels that the provision of no rear yard setback rather than requiring a rear yard "pocket" of twenty or fifteen feet as stipulated within the General Industrial and Limited Industrial zoned districts would be more conducive for industrial activities. Due to the nature of industrial activities, the Council feels that the amendment proposed in this bill will not militate against the intent of Code. Further, in situations when an industrial zoned lot abuts another zoned district, through the Plan Approval process, setbacks can be imposed to alleviate any potential adverse impact to the adjacent lot. SECTION 2. Section 25-212, Article 15, Chapter 25 of the Hawaii County Code is amended to read as follows: "Section 25-212. Minimum yards. [(a)] The minimum yards in MG districts shall be as follows: (1) Front [and rear] yard[s]: twenty feet. (2) Side and rear yards: none, except as required by plan approval." SECTION 3. Section 25-220, Article 16, Chapter 25 of the Hawaii County Code is amended to read as follows: "Section 25-220. Minimum yards. [(a)] Minimum yards in ML districts shall be as follows: (1) Front [and rear] yard[s]: fifteen feet. (2) Side and rear yards: none, except as required by plan approval." SECTION 4. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTION 5. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 6. This ordinance shall take effect upon its approval.
