ORDINANCE NO. 84 s~
AN ORDINANCE AMENDING ARTICLES 7, 8, 9, 15, 16, 17 AND 18,
CHAPTER 25, (ZONING CODE) OF THE HAWAII COUNTY CODE 1983, AS
AMENDED, RELATING TO PERMITTED USES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:

SECTION 1. Purpose. The Council finds that in some of the
zoned districts the Code implies that "aquaculture activity" is a
permitted use. This bill intends to clearly spell out that such use
is allowed within the Residential-Agricultural, Agricultural,
Intensive Agricultural, General Industrial, Limited Industrial, Open
and Unplanned zoned districts. This type of activity is compatible
with the stated objectives and purposes of the above-stated zoned
districts and their existing permitted uses.
SECTION 2. Section 25-144(a), Article 7, Chapter 25 of the
Hawaii County Code is amended by re-numbering subsection (16) and
inserting a new subsection (16) to read as follows:
"(16) Aquaculture activity.
[(16)] (17) Subject to approval by the director, buildings
and uses accessory to the above permitted uses."
SECTION 3. Section 25-152(a)(13), Article 8, Chapter 25 of the
Hawaii County Code is amended to read as follows:
"(13) Fish and poultry hatcheries, including aquaculture
activity."
SECTION 4. Section 25-160(a), Article 9, Chapter 25 of the
Hawaii County Code is amended by re-numbering subsection (8) and
inserting a new subsection (8) to read as follows:
"(8) Aquaculture activity.
[(8)] (9) Uses and buildings normally considered
accessory to the above permitted uses subject to the approval of
the director."
SECTION 5. Section 25-208(a), Article 15, Chapter 25 of the
Hawaii County Code is amended by re-numbering subsection (33) and
inserting a new subsection (33) to read as follows:
"(33) Aquaculture activity.
[(33)] (34) Buildings and uses normally considered
directly accessory to the above permitted uses."
SECTION 6. Section 25-216(a), Article 16, Chapter 25 of the
Hawaii County Code is amended by re-numbering subsection (22) and
inserting a new subsection (22) to read as follows:
"(22) Aquaculture activity.
[(22)] (23) Buildings and uses normally considered
directly accessory to the above permitted uses."
SECTION 7. Section 25-224(a), Article 17, Chapter 25 of the
Hawaii County Code is amended by re-numbering subsection (8) and
inserting a new subsection (8) to read as follows:
"(8) Aquaculture activity.
[(8)] (9) Uses considered directly accessory to the above
permitted uses."
SECTION 8. Section 25-232(a), Article 18, Chapter 25 of the
Hawaii County Code is amended by re-numbering subsection (7) and
inserting a new subsection (7) to read as follows:
"(7) Aquaculture activity.

[(7)] (8) Buildings and uses normally considered directly
accessory to the above permitted uses."
SECTION 9. Material to be repealed is bracketed. New material
is underscored. In printing this ordinance, the brackets, bracketed
material and underscoring need not be included.
SECTION 10. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts
of this ordinance.
SECTION 11. This ordinance shall take effect upon its approval.
