S~ 6S AN ORDINANCE AMENDING SECTION 23-49, DIVISION 4, ARTICLE 3, CHAPTER 23 (SUBDIVISION CODE) OF THE HAWAII COUNTY CODE 1983, AS AMENDED, RELATING TO STREET NAMES. BE IT ORDAINEll BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. This Council finds that although the Code does not require the County to adopt a Street Naming Policy, there is a need for such policy. The Council further finds that the Code allows duplicate street names provided that the streets are located in different judicial districts. To avoid confusion, the Council feels that no streets within the entire County should have duplicate names. SECTION 2. Section 23-49, Division 4, Article 3, Chapter 23 of the Hawaii County Code 1983, as amended, is hereby amended to read as follows: "Section 23-49. Street names. No street name shall be used which may duplicate or may be confused with the name of an existing street in [each individual district of] the County, provided that identical or similar names may be used to name extensions of existing streets. Street names shall conform to the [established pattern of] adopted policy of the County and shall be subject to the approval of the commission and adoption of same by the Council." SECTION 3. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTION 4. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 5. This ordinance shall take effect upon its approval.
