ORDINANCE NO. S'3 69
AN ORDINANCE AMENDING SECTION 25-66 (a), DIVISION 10, ARTICLE 1,
CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE 1983, AS AMENDED,
RELATING TO YARD PROJECTIONS AND OPEN SPACE.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The Council finds that there is a
discrepancy in the present language of the Code. For structures
requiring a setback of ten feet, the Code states that the structural
projections, i.e., eaves, porches, etc., may extend four and five
feet into the setback area. This bill intends to amend this
contradiction by stating that if the required structural setback to
the property line is less than ten feet, then the projection may
extend four feet into the setback area. If the structural setback
is ten feet to fifteen feet, then the projection may extend five
feet.
SECTION 2. Section 25-66 (a), Division 10, Article 1,
Chapter 25 of the Hawaii County Code 1983 is hereby amended to read
as follows:
"Section 25-66. Projections into required yards and open
spaces.
(a) Except as may otherwise be restricted, the following
projections or features may extend four feet into any required yard
or open space that is less than ten feet [or less], five feet when
required yard or space is from ten up to fifteen feet, and six feet
when required yard is over fifteen feet: cornices, canopies, eaves,
landing plans, porches, balconies, terraces, fire escapes, stairs,
ramps, and other similar features; provided that:
(1) None of the features shall be enclosed above or below
the extension except that there may be individual posts or beams for
support and open or grill type railings no higher than four feet; and
(2) No chimney may extend more than two feet into any
yard."
SECTION 3. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the brackets,
bracketed material and underscoring need not be included.
SECTION 4. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parties of this ordinance.
SECTION 5. This ordinance shall take effect upon its
approval.
