ORDINANCE No. 84 81
AN ORDINANCE AMENDING SECTION 25-149, ARTICLE 7, AND SECTION 25-157,
ARTICLE 8, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE 1983,
AS AMENDED, RELATING TO YARD AND HEIGHT REQUIREMENTS FOR
RESIDENTIAL-AGRICULTURAL AND AGRICULTURAL DISTRICTS WITH LESS THAN
THE MINIMUM BUILDING SITE AREA REQUIREMENT.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAiVAII:
SECTION 1. Purpose. The Council finds that the Code presently
states that if a lot within the Residential-Agricultural or
Agricultural zoned district has a land area less than that required
under that zoned district, then the uses permitted and the
structural regulations shall be the same as that of the Single
Family Residential or Residential-Agricultural zoned district. The
Council feels that only the structural requirements (setback and
height) should apply under these circumstances, and that the
permitted uses and other regulations should remain the same for a
lot within its respective zoned district.
SECTION 2. Section 25-149, Article 7, Chapter 25 of the Hawaii
County Code 1983, as amended, is hereby amended to read as follows:
"Section 25-149. Other regulations. If any leyal building
site in any RA district has an area less than one-half acre [of
area, then the uses permitted and the regulations for all structures
shall be the same as in an RS district having an area requirement
nearest that of the building site in question.], then the yard and
height requirements for the building site shall be the same as in
the RS districts."
SECTION 3. Section 25-157, Article 8, Chapter 25 of the Hawaii
County Code 1983, as amended, is hereby amended to read as follows:
"Section 25-157. Other regulations. If any legal building
site in an A district has an area of less than one acre, [the uses
permitted and the regulations for all structures on said building
site shall be the same as in an RA district having an area
requirement nearest that of the subject building site.] then the
yard and height requirements for the buildin site shall be the same
as in the RS districts."
SECTION 4. Material to be repealed is bracketed. New material
is underscored. In printing this ordinance, the brackets, bracketed
material and underscoring need not be included.
SECTION 5. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts
of this ordinance.
SECTION 6. This ordinance shall take effect upon its approval.
