HomeMy WebLinkAboutORD 1984-083 1984-1988BILL N0. 1146 (Draft 3 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE N0. 8 ~ B 3 AN ORDINANCE AMENDING CHAPTER 3 OF THE HAWAII COUNTY CODE 1983, RELATING TO ADVERTISING AND SIGNS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. This ordinance enacts language which will permit the erection of temporary banners over public thoroughfares for the purpose of advertising events conducted on public thoroughfares. SECTION 2. Chapter 3, Article 1, Division 1, Section 3-2(a), of the Hawaii County Code 1983 is hereby amended by adding a new subsection to read as follows: "( _ ) 'Temporary banner' means an outdoor decorations or advertising device announcing a meetin or series of meetings if displayed on the premises where the meetin or series of meetin s will be or is being held. Meeting, as used in this section, includes all meetin s whether open to the public or not, or whether conducted for profit or not and including but not limited to, sports events, conventions fairs, rallies, plays, lectures, concerts motion pictures dances, and religious services. Temporary banners shall not exceed one hundred souare feet in area, shall be limited in number to one per meeting, shall be displayed for a period not to exceed seven days except when authorized for lon er periods by the Chief Engineer during any calendar year and shall project over a public street or hi hway only if the lower ed e of the temporary banner has a vertical clearance of not less than fifteen feet above such street or hi hway " SECTION 3. Chapter 3, Article 1, Division 3, Section 3-32, of the Hawaii County Code 1983 is hereby amended by adding a new subsection (b) to read as follows: "(b) Temporary banners are exempt from all the provisions of this article except for the requirements of sections 3-16 3-17, 3-18, 3-19, 3-20 3-31(a)(3) and (4), and 3-33. Prior to the display of any temporary banner over any public area street or highwa the person, persons or entity displa in the banner shall file with the Clerk of the County of Hawaii proof of_a_public liability and propert dama e insurance policy which names the Count of Hawaii as an additional insured in the amount of not less than $300,000, and shall also save the said County of Hawaii, its officers or a ents, successors or assigns, free and harmless from all suits or actions of ever nature and kind which may be brought on account of any injury or damage, direct or indirect, arising out of the display of such temporary banner." SECTION 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or -2- applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need not be included. SECTION 6. This ordinance shall take effect upon its approval.
