ORDINANCE No. 84 84
AN ORDINANCE AMENDING SECTION 25-95 (KAWAIHAE-PUAKO ZONE MAP),
ARTICLE 3, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE,
BY CHANGING THE DISTRICT CLASSIFICATION FROM OPEN (O) TO SINGLE
FAMILY RESIDENTIAL (RS-15) AT LALAMILO, SOUTH KOHALA, HAWAII,
COVERED BY TAX MAP KEY 6-6-02:25.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-95, Article 3, Chapter 25 (Zoning
Code) of the Hawaii County Code, is amended to change the
district classification of property described hereinafter as
follows:
The district classification of the following area
situated at Lalamilo, South Hilo, Hawaii, shall be Single
Family Residential (RS-15):
Beginning at the east corner of this parcel of land and in
the southwest side of a Proposed 60-Foot Road, the
coordinates of said point of beginning referred to
Government Survey Triangulation Station "PUAKO" being
2580.57 feet North and 892.10 feet East, as shown on
Government Survey Registered Map 2826, thence running by
azimuths measured clockwise from True South:
1. 41° 30' 400.00 feet along Government Land and
passing over a pipe at
347.07 feet at the northwest
corner of Grant 10251 to A. L.
Forbes;
2. 131° 30' 70.00 feet along Government Land;
3. 214° 00' 110.00 feet along Government Land;
4. 140° 00' 54.88 feet along Government Land;
5. 221° 30' 297.93 feet along Government Land;
6. Thence along the southwest side of a Proposed 60-Foot
Road on a curve to the right with
a radius of 800.00 feet, the
chord azimuth and distance
being: 318° 33' S1"
81.95 feet;
7. Thence along the southwest side of a Proposed 60-Foot
Road on a curve to the left with
a radius. of 330.00 feet, the
chord azimuth and distance being
316° 30' 57.52 feet to the
point of beginning and containing
an Area of 49,502 Square Feet.
All as shown on the map attached hereto, marked
Exhibit "A" and by reference made a part hereof.
SECTION 2. This change in district classification is
subject to the condition that all applicable rules, regulations
and requirements be complied with. Should the foregoing
condition not be met, rezoning of the area to its original or
more appropriate designation may be initiated.
SECTION 3. In the event that any portion of the ordinance
is declared invalid, such invalidity shall not affect other
parts of this ordinance.
SECTION 4. This ordinance shall take effect upon its
approval.
