SS 3 3 AN ORDINANCE AMENDING SECTION 25-100 (NORTH HILO DISTRICT ZONE MAP), ARTICLE 3, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-20a) TO AGRICULTURAL (A-la) AND AGRICULTURAL (A-Sa) AT KAPENA, NORTH HILO, HAWAII, COVERED BY TAX MAP KEY 3-2-02:PORTION OF 41. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 25-100, Article 3, Chapter 25 (Zoning Code) of the Hawaii County Code, is amended to change the district classification of property described hereinafter as follows: The district classification of the following area situated at Kapena, North Hilo, Hawaii, shall be Agricultural (A-la): Beginning at the Northernmost corner of this parcel of land, being also a point on the Southwesterly side of Hawaii Belt Road (F.A.P. SDR 3(3)) and at the centerline of Waikolu Stream, the coordinates of said point of beginning referred to Government Survey Triangulation Station "HAIKU" being 2,566.01 feet North and 1,736.48 feet East and running by azimuths measured clockwise from True South: 1. 317° 40' 30" 244.12 feet along the Southwesterly side of Hawaii Belt Road (F.A.P. SDR 3(3)); Thence, for the next six (6) courses following along the remainder of Grant 4719 to J. R. Cadinha: 2. 52° 19' 205.00 feet along Lot 3-A; 3. 89° 58' 30.00 feet along Lot 3-B-3 of this subdivision; 4. 179° 58' 1.37 feet along Lot 3-B-3 of this subdivision; Thence, following along Lot 3-B-3 of this subdivision on a curve to the left with a radius of 285.00 feet, the chord azimuth and distance being: 5. 171° 58' 45" 79.21 feet; 6. 163° 59' 30" 22.23 feet along Lot 3-B-3 of this subdivision; 7. 137° 40' 30" 120.12 feet along Lot 3-B-3 of this subdivision; Thence, following along the meanderings of the centerline of Waikolu Stream, the direct azimuth and distance being: 8. 227° 23' 20" 171.10 feet to the point of beginning and containing an area of 1.000 Acre. (Refer to Parcel 3-B-1 as shown on Exhibit "A") The district classification of the followin g area situated at Kapena, North Hilo, Hawaii, shall be Agricultural (A-la): Beginning at the Southwesterly corner of this parcel of land, being also an angle point on the Northerly boundary of Lot 3-B-3 of this subdivision, the coordinates of said point of beginning referred to Government Survey Triangulation Station "HAIKU" being 2,012.13 feet North and 1,787.30 feet East and running by azimuths measured clockwise from True South: Thence, for the next three (3) courses following along the remainder of Grant 4719 to J. R. R. R. Cadinha; Thence, following along the meanderings of the center- line of Waikolu Stream, the direct azimuth and distance being: 20. 219° 14' S0" 782.13 feet to the point of beginning and containing an area of 8.423 Acres, more or less. (Refer to Parcel 3-B-3 as shown on Exhibit "A") All as shown on the map attached hereto, marked Exhibit "A" and by re ference made a part hereof. -5- SECTION 2. These changes in district classification are conditioned upon the following: (A) the petitioner, its assigns or successors, shall be responsible for complying with all conditions of approval; (B) the petitioner shall submit plans for subdivision approval within one year from the effective date of the change of zone ordinance. The petitioner shall also be responsible for securing final subdivision approval; (C) the requirements of the Department of Public Works and the State Department of Transportation, including roadway and drainage improvements, if any, shall be complied with; and (D) all other applicable rules, regulations and requirements, including the Department of Water Supply and the State Department of Health, shall be complied with. Should any of the foregoing conditions not be met the rezoning of the property to is original or more appropriate zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not the affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
