AN ORDINANCE AMENDING SECTION 25-103 (PUNA DISTRICT ZONE MAP),
ARTICLE 3, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE,
BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL
(A-20a) TO AGRICULTURAL (A-la) AND AGRICULTURAL (A-Sa) AT OLAA,
PUNA, HAWAII, COVERED BY TAX MAP KEY 1-8-05:47.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-103, Article 3, Chapter 25 (Zoning
Code) of the Hawaii County Code, is amended to change the
district classification of property described hereinafter as
follows:
The district classification of the following area
situated at Olaa, Puna, Hawaii, shall be Agricultural
(A-la):
Beginning at a point at the south corner of this parcel of
land and on the northerly end of a 20-Foot Government
Road, the coordinates of said point of beginning referred
to Government Survey Triangulation Station "OLAA" being
15,827.89 feet South and 16,149.14 feet West and running
by azimuths measured clockwise from True South:
1. 138° 53' 30" 148.16 feet along Lot "O", portion of
Grant 4091 to E.D. Baldwin;
2. 228° 53' 30" 294.00 feet along remainder of
Grant 4167 to W.D. Alexander,
Jr.;
3. 318° 53' 30" 148.16 feet along remainder of
Grant 4167 to W.D. Alexander,
Jr.;
4. 48° 53' 30" 294.00 feet along County of Hawaii's
Department of Water Supply Tank
Site No. 6; Lot 72-G,
Grant 10960 to Joe C. & Mary A.
Rezentes; and Lot 72-H,
Grant 10656 to Charles M.
Nakanishi to the point of
beginning and containing an
area of 1.000 Acre. (Refer to
Parcel 1 as shown on Exhibit
,. A., )
The district classification of the following area
situated at Olaa, Puna, Hawaii, shall be Agricultural
(A-5a):
Beginning at a point at the west corner of this parcel of
land, the coordinates of said point of beginning referred
to Government Survey Triangulation Station "OLAA" being
15,197.95 feet South and 16,698.85 feet West and running
by azimuths measured clockwise from True South:

All as shown on the map attached hereto, marked
Exhibit "A" and by reference made a part hereof.
SECTION 2. This change in district classification is
conditioned upon the fallowing: (A) the petitioner, successors
or its assigns shall be responsible for complying with all of
the stated conditions of approval; (B) subdivision plans shall
be submitted within one year from the effective date of
approval of the change of zone; (C) access to the property via
the existing 20-foot wide right-of-way shall be improved with a
12-foot wide pavement; and (D) all other applicable rules,
regulations, and requirements, including the minimum setback
requirements, shall be complied with. Should any of the
foregoing conditions not be met, rezoning of the area to its
original or more appropriate zoning designation may be
initiated.
SECTION 3. In the event that any portion of the ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 4. This ordinance shall take effect upon its
approval.
