HomeMy WebLinkAboutORD 1985-097 1984-1988COUNTY OF HAWAII STATE OF HAWAII Bill No. 95 ORDINANCE NO. 85 97 AN ORDINANCE AMENDING CHAPTER 5, HAWAII COUNTY CODE 1983, RELATING TO THE BUILDING CODE. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 5, Article 1, Section 5-8, Hawaii County Code 1983, is hereby amended to read as follows: "Section 5-8. Amending section 301[(a)]. Section 301[(a)] is amended to read as follows: (a) Permits Required. No person, firm or corporation shall erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish any building or structure in the County, or cause the same to be done, without first obtaining a separate building permit for each building or structure from the building official; provided that one permit may be obtained for a dwelling and its accessories, such as fence, wall, pool, and garage without living quarter. EXCEPTIONS: A PERMIT IS NOT REQUIRED FOR: 1. Work excepted under section 103. 2. Temporary construction sheds used exclusively for storage of materials, supplies and equipment during construction and temporary construction fences. 3. Reroofing work and installation of siding to existing exterior walls which will not affect the structural components of the walls for Groups R-3 and M Occupancies. 4. Temporary tents or other coverings used for private family parties or for camping. 5. Home television and radio antennas supported on roofs. 6. Awnings projecting up to four feet and attached to the exterior walls of buildings of Group R-3 or M Occupancy; provided that the awnings do not violate the provision for "yards" in chapter 25 (zoning) of the County code. 7. Standard electroliers not over 35 feet in height above finish grade. 8. .Installation of wallpaper or wall covering which are exempted under the provisions of section 4201. 9. Repairs which involve only the replacement of component parts or existing work with similar materials for the purpose of maintenance, and which do not aggregate over $300 in valuation in any twelve-month period, and do not affect any electrical or mechanical installations. Repairs exempt from permit requirements shall not include any addition., change, or -2- modification in construction, exit facilities, or permanent fixtures or equipment. Specifically excepted from permit requirements without limit to valuation are: (A) Painting and decorating. (B) Installation of floor covering. (C) Cabinet work which is not regulated under section 513. 10. Work performed under the jurisdiction of federal government and/or located in federal property. (b) Emergency Work. Emergency work may commence without a permit; however, a permit for the work shall be obtained on the working day immediately following the day work is commenced. (c) Temporary Permit Required. No person, firm or corporation shall erect any tent or similar structure which is to be used for commercial or religious purposes, such as rallies, festivals, amusements and sideshows, without first obtaining a temporary permit for the tent or structure from the building official. To secure a permit, approval must also be obtained from the chief of the fire department. A permit for a tent or similar structure shall be non-renewable and limited to a period of not more than thirty consecutive days and may be cancelled for cause by the building official or the fire department at any time before expiration of the time stated in the permit. Upon cancellation or -3- upon the expiration of the time stated in the permit the structure or structures shall be promptly removed. No tent of canvas, plastic or similar material shall be used for residence purposes." SECTION 2. Chapter 5, Article 1, Hawaii County Code 1983, is hereby amended by adding a new section between section 5-12 and 5-13 to be appropriately numbered and to read as follows: "Section- Amending Section 304(a). Section 304 (a) is amended to read as follows: Sec. 304. (a) Permit Fees. (1) The fee for each permit shall be as set forth in Table 3-A. (2) The determination of value or valuation under any of the provisions of this code shall be made by the Buildin Official. The valuation to be used in com uting the ermit fees shall be the total value of all construction work for which the permit is issued, as well as all finish work, paintin , roofing, electrical, plumbing, heating, air conditioning, elevators, fire-extinguishing systems and any other permanent work or ermanent equipment. (3) Where work for which a permit is required by this code is started or proceeded with prior to obtaining said permit the fees specified shall be doubled, but the ayment of such double fee shall not relieve any person from fully complyin with -4- the requirements of this code in the execution of the work nor from any othec penalties prescribed in this Code." SECTION 3. Chapter 5, Article 1, Hawaii County Code 1983, is hereby amended by adding a new section between section 5-20 and 5-21 to be appropriately numbered and to read as follows: "Section Amending section 305(e). Section 305-(e) is amended to read as follows: (e) Required Inspections. The building official, upon notification from the permit holder or his agent, shall make the following inspections and shall either approve that portion of the construction as completed or shall notify the permit holder or his agent wherein the same fails to comply with this code: 1. FOUNDATION INSPECTION: To be made after trenches are excavated and forms erected and when all materials for the foundation are delivered on the job. Where concrete from a central mixing plant (commonly termed "transit mixed") is to be used, materials need not be on the job. 2. CONCRETE SLAB OR UNDER-FLOOR INSPECTION: To be made after all in-slab or under-floor building service equipment, conduit, piping accessories and other ancillary equipment items are in place but before any concrete is poured or floor sheathing installed, including the subfloor. -5- 3. FRAME INSPECTION: To be made after the roof, all framing, fire blocking and bracing are in place and all pipes, chimneys and vents are complete and the rough electrical, plumbing, and heating wires, pipes and ducts are approved. 4. LATH AND/OR GYPSUM BOARD INSPECTIONS: To be made after all lathing and gypsum board, interior and exterior, is in place but before any plastering is applied or before gypsum board joints and fasterners are taped and finished. 5. FINAL INSPECTION: To be made after finish grading and the building is completed and ready for occupancy." SECTION 4. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need not be included. SECTION S. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. -6- SECTION 6. This ordinance shall take effect upon its approval.
