ORDINANCE NO. 85 104
AN ORDINANCE AMENDING CHAPTER 22, ARTICLE 1, DIVISION 7,
SECTION 22-32, HAWAII COUNTY CODE 1983, RELATING TO THE
OBSTRUCTION OF PUBLIC STREETS OR SIDEWALKS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECZ'IGN 1. Chapter 22, Article 1, Division 7, Section 22-32,
Hawaii County Code 1983, is amended to read as follows:
"[It shall be unlawful for any peddler, solicitor, or
canvasser to engage in business on any public street, sidewalk, or
other public place if that person intentionally or knowingly
impedes or obstructs the public or any person in the lawful use of
that street, sidewalk, or other public place, or where that
person's business or activity endangers any person or property on
that street, sidewalk, or other public place.] (a) It shall be
unlawful for any person having no legal privilege to do so, to
knowingly or recklessly render impassable, without unreasonable
inconvenience or hazard, any public street, right of way,
crosswalk or sidewalk, whether alone or with others. (b) It
shall be unlawful for any person to knowingly or recklessly engage
in conduct which creates an unreasonable risk of harm to any
person or property on such public street, right of way, crosswalk
or sidewalk."
SECTION 2. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material and underscoring need not be included.
SECTION 3. If any provision of this ordinance or the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 4. This ordinance shall take effect upon its
approval.
