AN ORDINANCE AMENDING CHAPTER 18 OF THE HAWAII COUNTY CODE
1983, RELATING TO PUBLIC TRANSPORTATION.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 18-1, Article 1, Chapter 18 of the
Hawaii County Code 1983, as amended, relating to public
transportation, is hereby amended as follows:
"Section 18-1. Definitions.
(a) As used in this chapter:
(1) "Carrier" means every person, individual,
corporation, joint stock company, firm, association,
lessee, trustee, receiver, or trustee appointed by any
court, who or which owns, controls, operates, or manages a
passenger-carrying motor vehicle, such as a sampan bus,
taxi or other vehicle exempted from Chapter 271, Hawaii
Revised Statutes, operated in the transportation of the
general public, over a prescribed route on a regular
schedule over any public street or highway within the
county; but not including:
(A) Persons transporting passengers without
charge in motor vehicles owned or operated by such person,
where such transportation is provided in conjunction with
and in furtherance of a related primary business purpose
or enterprise of that person, except that this er.e;~ption
shall not apply to persons making any contract, agreement,
or arrangement to provide, procure, furnish, or arrange
for transportation as a travel agent or broker or a person
engaged in tour or sightseeing activities, nor shall this
exemption apply where the transportation is undertaken by
a person to evade the regulatory purposes of this chapter;
(B) Sightseeing buses;
(C) Private transportation services of churches
and employers;
(D) Student transportation; and
(E) Any mass transit system owned, maintained,
and operated by the County of Hawaii including, but not
limited to, motor buses, street railroads, and fixed rail
facilities.
(2) "Commission" means the county transportation
commission.
(3) "Handicapped" means any individual meeting one
or more of the following standards and guidelines:
(A) Any individual who by reason of illness,
injury, advanced age, congenital malfunction, or other
incapacity or disability, is unable to compete in the open
iob market for a period of more than one year.
(B) Any individual unable to perform one or
more of the following functions necessary to effectively
utilize public transportation facilities without
significant difficulty.

(i) negotiation a flight of stairs
(ii) boarding or alighting from a public
transit vehicle
(iii) walking more than 200 feet
(C) Any individual unable without special
facilities, special assistance, and special planning or
design to utilize the public transit system as effectively
as persons who are not so affected.
Supporting evidence of the handicap shall
be required by a licensed physician or a ency involved in
physical or mental handicap programs. The handicap
identification card issued by the County of Hawaii Mass
Transportation Agency shall be reco nized for certified
handicapped individuals.
((3)](4) "Public highways" means the same as the
definition of public highways in section 264-1, Hawaii
Revised Statutes, including both state and county
highways, but operation upon rails is not transportation
on the public highways.
((4)](5) "Safety glass" means any product composed of
glass, manufactured, fabricated, or treated so as to
substantially prevent shattering and flying of the glass
when struck or broken or any other or similar product as
may be approved by the chief of police.

(6) "senior citizens" means any individual a e 60
and over and maintains a senior citizen identification
card issued by the County of Hawaii, Department of Parks
and Recreation, Elderly Activities Division.
(7) "Student" means any individual currently
attending an educational institution certified b the
State of Hawaii and maintains supporting evidence of
present enrollment such as a student identification card
[(5)](8) "Taxi" means any vehicle designed to carry
passengers, operating for hire solely on call or demand
from a fixed stand, and accepting passengers with or
without baggage for the transportation on the public
highways between points as may be directed by the
passengers. No vehicle is a taxi if passengers are picked
up by it on a public highway on the route of a carrier
certificated by the council, except that the picking up of
a passenger by a vehicle returning by the most direct
route, after having discharged a passenger, to the stand
where the vehicle is regularly stationed, when empty and
hailed by the passenger for that purpose, shall not
prevent said vehicle from being classed as a taxi,"
SECTION 2. Chapter 18 of the Hawaii County Code 1943
relating to public transportation is amended by adding a new
article to read as follows:

"ARTICLE 4. PUBLIC TRANSIT SYSTEM
Division 1. ISLAND-WIDE FARE STRUCTURE
Section 18- FARE SCHEDULES. Ever erson usin
the mass transit service owned, maintained or o erated by
the County of Hawaii shall be charged the fares set out in
the following schedules:
(a) HILO-HAMAKUA-WAIMEA-KONA. For one-way travel
within each zone set out in Fare Schedule A, a base cash
fare of $.75 will be collected. For one-way travel
between any two zones, the cash fare to be collected is
set out in said Fare Schedule A, ap ended hereto and made
a part hereof.
(b) HILO-PUNA-KA'U. For one-way travel within each
zone set out in Fare Schedule B, a base cash fare of $.75
will be collected. For one-way travel between any two
zones, the fare to be collected is set out in said Fare
Schedule B, appended hereto and made a part hereof•
(c) SOUTH KOHALA HOTELS. For one-way travel between
those areas described in the Fare Schedule C and those
South Kohala Hotels described in said fare schedule, the
cash fares to be collected are set out in said Fare
Schedule C, appended hereto and made a part hereof
(d) FARE PREPAYMENT llISCOUNT. All tickets for
travel between the points set out in above schedules can
be pre-purchased at a discount of l00 off the scheduled

cash fare. The monthly bus pass fare plan shall be based
upon individual issuance of bus asses for travel within
and between designated zones set out in the above
schedules upon payment of the designated monthly bus fares
to the Mass Transportation Agency. The 108 discount in
this paragraph shall not apply to the Demand Response Fare
(e) FARE PREPAYMENT DISCOUNT FOR SENIOR CITIZENS,
HANDICAPPED PERSONS AND STUDENTS. All tickets for travel
by senior citizens, handicapped persons and students,
between the points set out in the above schedules can be
pre-purchased at a discount of 33 1/3~ off the scheduled
cash fare. The monthly bus pass fare plan shall be based
upon individual issuance of bus asses for travel within
and between designated zones set out in the above
schedules upon payment of the desi Hated monthly bus fares
to the [9ass Transportation A ency. The 10~ discount in
paragraph (d) shall not appl to pre-paid tickets and
monthly bus passes purchased pursuant to this Para raph
The 33 1/3~ discount in this aragraph shall not apply to
the Demand Response Fare.
Section 18- 3AGGF,GE. A driver of any mass
transit bus owned, maintained and operated by the Coun
of Hawaii shall charge $1.00 for each iece of baggage,
including backpacks, except that any small ba such as a
train case, handbag, briefcase, or a package that can be
carried on the lap of the passen er and within his or her
respective seat shall be conveyed without charged."

SECTION 3. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material and underscoring need not be
included.
SECTION 4. If any provision of this ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without
the invalid provision or application, and to this end, the
provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its
approval.
