AN ORDINANCE AMENDING SECTION 25-87 (NORTH KONA ZONE hiAP)
ARTICLE 3, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE,
BY CHANGING THE DISTRICT CLASSIFICATION FROM UNPLANNED (U) TO
AGRICULTURAL (A-la) AT HONOKOHAU, NORTH KONA, HA4dAII COVERED BY
TAX MAP KEY 7-4-06:23
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-87, Article 3, Chapter 25 (Zoning
Code) of the Hawaii County Code, is amended to change the
district classification of property described hereinafter as
follows:
The district classification of the following area
situated at Honokohau, North Kona, Hawaii, shall be
Agricultural (A-la):
Beginning at the Southeasterly corner of this parcel of
land, being also a point on the Westerly side of Mamalahoa
Highway, the coordinates of said point of beginning
referred to the Hawaii State Plane Coordinate System,
Zone I, being 308,884.92 feet North and 337,252.85 feet
East and running by azimuths measured clockwise from True
South:
1. 75° 38' 36" 1,195.13 feet along Grant 3456
to George McDougall to
a pipe;
2. 165° 38' 36" 200.00 feet along Lot 2 and
along the remainder of
Land Commission
Award 9971, Apana 9 to
w. P. Leleiohoku to a
pipe;
3. 252° 36' 47" 719.21 feet along Lot 2 and
along the remainder of
Land Commission
Award 9971, Apana 9 to
W. P.~Leleiohoku.
Thenc e, for the next eight (8) courses following along

4. 268° 24' 64.90 feet to a point;

10. 260° 30' 18.10 feet to a point;
11. 253° 32' 52.00 feet to a point;

containing an area of
5.433 acres.
All as shown on the m ap attac hed hereto, marked
Exhib it "A" and by referen ce made a part hereof.
SECTI ON 2. This change in distric t classification is
conditioned upon the following: (A) th e petitioners, their
successors or as signs shall be responsi ble for complying with

all stated conditions of approval; (B) subdivision plans for
the proposed development shall be submitted to the planning
department within one year from the effective date of approval
of the change of zone. Final subdivision plans shall be
submitted for the proposed development within one year from the
effective date of tentative subdivision approval; (C) the
proposed access and interior roadways shall meet with the
approval of the Department of Public Works; (D) that the
requirements of the Department of Water Supply shall be
complied with; and, (E) that all. other County and State rules,
regulations and requirements shall be complied with. The
Planning Director may administratively grant extensions to the
foregoing time conditions. Further, should any of the
foregoing conditions not be met or substantially complied with
in a timely fashion, the Planning Director may initiate
rezoning of the area to its original or more appropriate
designation.
SECTION 3. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
SECTION 4. This ordinance shall take effect upon its
approval.
