AN ORDINANCE AMENDING CHAPTER 2 OF THE HAWAII COUNTY CODE 1983
RELATING TO SELF-INSURANCE FUND.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The purpose of this ordinance is to

create a self-insurance fund from which large claims against the
County may be paid. This self-insurance fund should be a
self-perpetuating, revolving fund and should be funded accordingly.
SECTION 2. Chapter 2 of the Hawaii County Code 1983 is
amended by adding a new article to read as follows:
"Article 27. Self-Insurance Fund.
Section 1. Creation of Fund. Pursuant to Section 10-12 of
the Hawaii County Charter, a special fund to be known as the
self-insurance fund is hereby created
Section 2. Funding. The self-insurance fund shall be funded
by an initial appropriation of $500 000 Thereafter, there shall
be an annual appro riation to the pelf-insurance fund in an amount
to be determined by the Mayor and Hawaii County Council
Section 3. Expenditures from the Self-Insurance Fund
(a) Subject to approval by the Hawaii County council, the
moneys in the self-insurance fund shall only be utilized as
follows:
(1) When the amount in the self-insurance fund is less
than $3,000,000, the fund shall only be used to pay claims
settlements, and jud ments, exclusive of workers' compensation
claims, against the County where the amount of such claim,
settlement, or judgment is in excess of $1,000,000
(2) When the amount in the self-insurance fund is more than
$3,000,000, the fund shall be used to pay all claims, settlements,
and judgments a ainst the County, exclusive of workers'
compensation claims.
Section 4. Dissolution of the Fund. The self-insurance fund
may not be dissolved or used for any pur ose not specified in
section 3, unless such dissolution or nonspecified use is a proved
the unanimous vote of the Hawaii county council
Section 5. Administration of the Fund. The director of
finance shall administer the special insurance fund which shall
include investment of the fund."
SECTION 3. New material is underscored. In printing this
ordinance, the underscoring need not be included.
SECTION 4. If any provision of this ordinance or the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.

SECTION 5. 7'h is ordinance shall take effect upon its
approval,
