AN ORDINANCE AMENDING SECTION 25-103 (PUNA DISTRICT ZONE MAP),
ARTICLE 3, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE,
BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL
(A-20a) TO AGRICULTURAL (A-5a) AT KEAAU, PUNA, HAWAII, COVERED
BY TAX MAP KEY 1-6-03:PORTION OF 73.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-103, Article 3, Chapter 25 (Zoning
Code) of the Hawaii County Code, is amended to change the
district classification of properties described hereinafter as
follows:
The district classification of the following area
situated at Keaau, Puna, Hawaii, shall be Agricultural
(A-Sa):
Beginning at the southeast corner of this parcel of land
on the southwest side of Lot 3 as shown on Map 1, Land
Court Application 1689, and on the north side of
Easement 1, as shown on Map 1, Land Court Application
1053, the coordinates of said point of beginning referred
to Government Survey Triangulation Station "OLAA" being
12,257.68 feet North and 7,828.97 feet East and running by
azimuths measured clockwise from True South:
1. 79° OS' 130.62 feet along the north side of
Easement 1, along the
remainder of Lot 1150-D-2 as
shown on Map 87, Land Court
Application 1053;
2. 75° 00' 292.87 feet along the north side of
Easement 1, along the
remainder of Lot 1150-D-2 as
shown on Map 87, Land Court
Application 1053;
3. 65° 42' 357.13 feet along the north side of
Easement 1, along the
remainder of Lot 1150-D-2 as
shown on Map 87, Land Court
Application 1053;
4. 73° 29' 60.32 feet along the north side of
Easement 1, along the
remainder of Lot 1150-D-2 as
shown on Map 87, Land Court
Application 1053;
5. 84° 54' 21.10 feet along the north side of
Easement 1, along the
remainder of Lot 1150-D-2 as
shown on Map 87, Land Court
Application 1053;
6. 180° 33' 579.27 feet along the north side of
Easement 1, along the
remainder of Lot 1150-D-2 as
shown on Map 87, Land Court
Application 1053;
7. 270° 33' 140.94 feet along Lot A-31-A as
shown on Map 22, Land Court
Application 1053;
8. 201° 00' 71.93 feet along Lot A-31-A as
shown on Map 22, Land Court
Application 1053;
9. Thence along Lot 3 as shown on Map 1, Land Court
Application 1689, along a
curve to the left having a
radius of 1,166.28 feet, the
chord azimuth and distance
being:
304° 48' 39" 283.25 feet;
10. 297° 50' 464.38 feet along Lot 3 as shown on
Map 1, Land Court
Application 1689 to the
point of beginning and
containing an area of
6.002 Acres.
All as shown on the map attached hereto, marked
Exhibit "A" and by reference made a part hereof.

SECTION 2. These changes in district classification are
conditioned upon the following: (A) the petitioner, its
successors or assigns shall be responsible for complying with
all of the stated conditions of approval; (B)°subdivision plans
shall be submitted within one. year from. the effective date of
approval of the change of zone; and (C) all other applicable
rules, regulations and requirements shall be complied with.
The Planning Director may administratively grant extensions to
the foregoing time conditions. Further, should any of the
foregoing conditions not be met or substantially complied with
in a timely fashion, the Planning Director may initiate
rezoning of the property to its original or more appropriate
designation.
SECTION 3. in the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
SECTION 4. This ordinance shall take effect upon its
approval.
