ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 22, ARTICLE 3, OF THE HAWAII COUNTY
CODE 1583, RELATING TO PERMIT FEES FOR THE CONSTRUCTION, REPAIR,
AND EXCAVATION OF STREETS AND SIDEWALKS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The purpose of this ordinance is to amend
chapter 22, Article 3, of the Hawaii County Code to increase
certain permit fees to reflect the increased costs to the County
of Hawaii in the issuance and processing of such permits where the
fees have been fixed at the present rates since 1947.
SECTION 2. Chapter 22, Article 3, Section 22-47, relating to
permit fees for the excavation of public streets and sidewalks, is
amended to read as follows:
"Section 22-47. Fees.
(a) The applicant for a permit shall be required to pay, at
the time of making application, a fee of [25] 50 cents per lineal
foot for the first fifty feet or less and [2-1/2] 5 cents per
lineal foot for all inexcess of fifty feet of opening that is to
cut into any public highway, street, alley, sidewalk or any other
public place, but no fee shall be less than [$7.50] $15.00.
(b) The fee requirement shall not apply in any case where
under the Constitution or laws of the United States such fee
cannot legally be imposed. No fee shall be required where the
only work involved is the setting of poles and guys to carry
overhead wires.
(c) If the application is not approved, the fee shall be
returned to the applicant."
SECTION 3. Chapter 22, Article 3, Section 22-61, relating to
permits for driveway approach, is amended to read as follows:
"Section 22-61. Permit application; content; fees.
(a) Application for a permit shall be made to the chief
engineer and shall state the location, grade, and dimensions of
the proposed driveway approach, and the purpose for which it is
desired. If the proposed driveway approach complies with the
provisions of this division, the chief engineer shall issue a
permit therefor.
(b) The fee for the permit shall be [$7.SOJ $15.00. The fee
shall be pain by the applicant at the time of the receipt of the
permit."
SECTION 4. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material, and underscoring need not be
included.
SECTION 5. If any provision of this ordinance or the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid

provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 6. This ordinance shall take effect upon its
approval.
