ORDINANCE NO. 86 99
AN ORDINANCE AMENDING CHAPTER 14, ARTICLE 6, OF THE HAWAII COUNTY
CODE 1983, RELATING TO PROPERTY OFFENSES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Findings and Purpose. The Council finds that the
defacement of County property by graffiti has reached epidemic
proportions. The purpose of this ordinance is to provide a
prohibition and penalty for injuring or defacing property owned or
controlled by the County of Hawaii.
SECTION 2. Chapter 14, Article 6, of the Hawaii County Code
1983, relating to property offenses, is amended by adding a new
subsection to be appropriately numbered and to read as follows:
"Section 14- Property damage prohibited; penalty.
(a) It shall be unlawful for any person maliciously or
wilfully to mar, injure, damage, destroy, or deface or aid in
marring, injuring, damaging, destroying, or defacing any public
buildiny, sign, sidewalk, light pole, wall fixture, playground,
structure, facility, or other property of the County without its

(b) Any person violating this provision shall be punished,
upon conviction, by a fine not exceeding $1,000 or by imprisonment
not to exceed ninety days, or both. In addition to the penalties
provided herein, the County may recover for damages to its
property, the measure of which shall be the cost of repairing,
replacing, or rebuilding the property injured or destroyed."
SECTION 3. New material is underscored; however, in printing
this ordinance, the underscoring need not be included.
SECTION 4. If any provision of this ordinance or the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its
approval.
