ORDINANCE NO. 86 100
AN ORDINANCE AMENDING CHAPTER 15, ARTICLE 1, SECTION 15-7, OF THE
HAtidAIZ COUNTY CODE 1983, RELATING TO PARKS AND RECREATION.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The purpose of this ordinance is to
correct a deficiency in the 1983 codification which appears to
limit the penalty provision to violations of article 1 of
chapter 15. Under the former County Code, the provisions for
County parks and recreational areas, including the restrictions
and prohibitions, were contained in a single article.
SECTION 2. Chapter 15, article 1, section 15-7, of the
Hawaii County Code 1983, relating to penalties for violations in
County parks and recreational areas is amended to read as follows:
"Section 15-7. Penalty. Any person
convicted or violating any provision contained
in this [article] chapter shall be punished by
a fine not exceeding [$500] $1,000 or by
imprisonment not to exceed [sixty] ninety
days, or both, and shall be adjudged to pay
all costs of the proceedings. In addition to
the penalties provided herein, the County may
recover for damages to its property, the
measure of which shall be the cost of
repairing, replacing, or rebuilding the
Property injured or destroyed."
SECTION 3. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material, and underscoring need not be
included.
SECTION 4. If any provision of this ordinance or the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its
approval.
