AN ORDINANCE AMENDING CH[HPTER 24, ARTICLE 7, DIVISION 1, OF THE
HAWAII COUNTY CODE 1983, RELATING TO TRAFFIC REGULATIONS.
BE IT ORDAINED BY THE CGUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 24, Article 7, Division 1,
Section 24-145(d), relating to no-passing zones, is amended to
read as follows:
"(d) Determination for no-passing at curves and signs and
markings designating no-passing zones shall be in accordance with
[sections 2B-7, 2B-8, 2B-9, 1B-21 and 1B-22 of the 'Manual of
Uniform Traffic Control Devices for Streets and Highways'
published by the U. S. Department of Commerce, Bureau of Public
Works, dated June 1961, which sections are adopted by reference
and made a part hereof. Three copies of said sections of 'Manual
on Uniform Traffic Control Devices for Streets and Highways' shall
be kept on file and be available for public inspection in the
County Clerk's office] the 'Manual on Uniform Traffic Control
Devices for Streets and Highways' (MUTCD) published by the U. S.
DeQartment of Transportation, Federal Highway Administration,
1978 edition, as revised from time to time. The MUTCD is on file
and is available for public inspection at the County clerk's
office."
SECTION 2. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material, and underscoring need not be
included.
SECTION 3. If any provision of this ordinance or the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 4. This ordinance shall take effect upon its
approval.
