HomeMy WebLinkAboutORD 1986-119 1984-1988COUNTY OF HAWAII STATE OF HAWAII BILL NO. zas ORDINANCE NO. 86 119 AN ORDINANCE AMENDING THE HAWAII COUNTY CODE 1983, RELATING TO DIVISIONS WITHIN THE DEPARTMENT OF PUBLIC WORKS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this ordinance is to amend the Hawaii County Code to simplify and create uniformity in identifying the divisions within the department of public works. SECTION 2. Chapter 2, Article 9, Section 2-41, of the Hawaii County Code 1983 is amended to read as follows: "Section 2-41. Divisions within department. (a) The department of public works shall be divided under the chief engineer into the following divisions: (1) The Engineering [and Surveys] Division. The engineering [and surveys] division is responsible for coordinating the planning, engineering, and implementation of the highway and drainage capital improvement projects, coordinating all land surveying, conducting necessary land rights acquisition, and providing construction inspectional services. (2) Traffic [Services] Division. The traffic [services] division determines the location, installs, maintains, and repairs all traffic control facilities and devices and street lighting. systems; is responsible for all traffic engineering in the County; maintains a traffic education program; and is responsible for the installation, maintenance, and repair of on and off-street parking meters. (3) Building Division. The building division is responsible for public building construction and inspection; plans, specifications and applications for private building and construction; plumbing, electrical and building permits; and the enforcement of all County ordinances related to building, construction and inspection. (4) Highway Maintenance Division. The highway maintenance division shall be responsible for the construction and maintenance of all roads, streets, highways, footpaths, storm drains, bridges, flood channels, and certain cemeteries. (5) [Wastewater and Solid] Waste Management Division. The [wastewater and solid] waste management division shall be responsible for the construction, maintenance, and operation of all sewage works and systems and solid waste disposal programs and facilities for the County. (6) Automotive Division. The automotive division shall: (A) Be responsible for the repair and maintenance of all garage, shop, and automotive equipment of the County, except such equipment as may be more practically maintained by the department having control thereof as determined by the chief engineer; (B) Furnish parts, accessories, gasoline, lubricants, and tires necessary for the repair for automobiles, trucks, -2- shovels, cranes, graders, sweepers, compressors, and other such machinery or equipment; and (C) Be authorized to bill any department, agency, or special fund for supplies, services, and use of equipment." SECTION 2. Chapter 20, article 1, section 20-8, of the Hawaii County Code 1983, relating to refuse, is amended to read as follows: "Section 20-8. Penalty. Any person who violates the provisions of this article shall, upon conviction, be sentenced to pay a fine not less than $100 nor more than $500 and/or to imprisonment or to public service with the [division of sewers and sanitation] waste management division, department of public works or the division of parks maintenance, department of parks and recreation, for a period not exceeding five days." SECTION 3. Chapter 21, article 1, section 21-2, of the Hawaii County Code 1983, relating to sewers, is amended by amending the definitions of "bureau of buildings" and "bureau of sewers" set out in subsections (a)(2) and (a)(3), respectively, to read: "(2) 'Bureau of buildings' means the [bureau of building construction and inspection] building division, County department of public works. (3) 'Bureau of sewers' means the (bureau of sewers and sanitation] waste management division, County department of public works." -3- SECTION 4. Chapter 21, article 4, section 21-34, of the Hawaii County Code 1983 is amended to read as follows: "Section 21-34. Sewer Fund designated; disposition of funds. The funds received from the collection of the sewer service charges authorized by this chapter shall be deposited daily with the director of finance, shall be accounted for and be known as the 'County sewer fund' and shall be expended for the purpose authorized. The County sewer fund shall consist of two accounts. The first account will be the 'user charge account' and the revenues for this account will come only from the sewer service charges. Expenditures from this fund shall be limited for the purpose of carrying out the operation and maintenance of the sewage treatment system, including replacement. The second account will be the 'fixed costs account.' Expenditures from this account shall be for items such as billing expenses, debt service charges, construction costs, etc. This financial management system shall be maintained by the [bureau of sewers and sanitation] waste management division and based on an adequate budget identifying basis for determining the annual operation and maintenance costs and the costs of personnel, material, energy, and administration." SECTION 5. Chapter 22, article 3, division 4, section 22-63, of the Hawaii County Code 1983 is amended to read as follows: "Section 22-63. Referral of building plans to chief engineer. All plans submitted to the [bureau of building -4- construction and inspection] building division for approval which include or involve unusual driveway approaches or problems, or which include or involve the ingress or egress to and from a government right of way, public highway, street, or sidewalk, shall be referred by the [bureau of building construction and inspection] building division to the chief engineer for his approval." SECTION 6. Chapter 22, article 4, division 1, section 22-72, of the Hawaii County Code 1983 is amended by amending the definition of "Highway Utility Encroachment Committee" set out in subsection (a)(23) to read as follows: "(23) 'Highway Utility Encroachment Committee' includes the head of the [bureau of plans and surveys (chairman)] engineering division, head of the [bureau of road construction and maintenance] highway maintenance division, and head of the [division of traffic safety and control] traffic division or duly authorized representative of the [bureaus and division] divisions." SECTION 7. The Hawaii County Code 1983 is amended by amending the title "division of automotive equipment" wherever it appears therein to "automotive division." SECTION 8. The Hawaii County Code 1983 is amended by amending the title "bureau of building construction and inspection" wherever it appears therein to "building division." SECTION 9. The Hawaii County Code 1983 is amended by amending the title "bureau of road construction and maintenance" wherever it appears therein to "highway maintenance division." -5- SECTION 10. The Hawaii County Code 1983 is amended by amending the titles "division of traffic safety and control" and "traffic services division" wherever either appears therein to "traffic division." SECTION 11. The Hawaii County Code 1983 is amended by amending the titles "bureau of plans and surveys" and "engineering and surveys division" wherever either appears therein to "engineering division." SECTION 12. The Hawaii County Code 1983 is amended by amending the titles "bureau of sewers and sanitation" and "wastewater and solid waste division" wherever either appears therein to "waste management division." SECTION 13. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need not be included. SECTION 14. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. -6- SECTION 15. This ordinance shall take effect upon its approval.
