BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: 246 SECTION 1. Purpose. The Council finds that there exists a need to establish by ordinance an advisory committee to assist the County in veterans affairs, including carrying out its responsibilities under Section 363-5, Hawaii Revised Statutes, relating to the establishment of veterans cemeteries in the County of Hawaii. It is the purpose of this ordinance to provide for the organization and responsibilities of the Veterans Advisory Committee. SECTION 2. Chapter 15 of the Hawaii County Code 1983 is hereby amended by adding a new article to read as follows: "Article Veterans Advisory Committee. Section 15- Organization. 'T'here shall be a committee composed of thirteen (13) members, who shall be appointed by the Mayor and confirmed by the Council. Any member of the committee may be removed upon a recommendation of the Mayor and the approval of the Council. Section 15- Membership and tenure. (a) The members shall serve staggered terms of five (5) years. (b) The membership of the committee shall include one (1) representative each from the American Legion, Big Island Retired Military Association, Club 100, Disabled American Veterans, Fleet Reserve Association, 442nd Veterans Association, Hilo Interpreters Club, Veterans of Foreign Wars, and the Veterans of the Vietnam War. (c) Initially, two members shall be appointed for a term of one (1) year, two members shall be appointed for a term of two (2) years, three members shall be appointed for a term of three (3) years, three members shall be appointed for a term of four (4) years, and three members shall be appointed for a term of five (5) years. (d) Any vacancy on the committee shall be filled for the remainder of the unexpired term, but members whose terms have expired may continue to serve until their successors have been appointed and confirmed. (e) No member shall be eligible for a second appointment to the committee prior to the expiration of two (2) years, provided that members initially appointed for a term of one (1) or two (2) years shall be eligible to succeed themselves for an additional term. - 2 - (f) In addition, the Hawaii Island Veterans Affairs Advisor (Department of Social Services of the State of Hawaii) and the Director of the Department of Parks and Recreation of the County of Hawaii, or their designa*_es, shall be ex-officio members of the committee. Section 15- Meetings of the committer. There shall be a chairman and vice-chairman of the committee who shall be elected by the members from their membership. The meetings of the committee shall be called at the discretion of the chairman or at the request of the majority of the members of the committee with the time and place to be determined by the chairman. Section 15- Powers and duties of the committee. It shall be *_he duty of the committee to act in an advisory capacity to the Mayor and the Council concerning all matters pertaining to the operation, management, and maintenance of the veterans cemeteries in the County of Hawaii. At the request of the Mayor or the Council, the committee shall discuss and make recommendations on other veterans-related issues. The committee may recommend such rules and regulations as it may deem necessary for the proper management of the veterans cemeteries, or for the orderly transaction of matters referred to it. - 3 - SECTION 3. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 4. 'T'his ordinance shall take effect upon its approval.
