ORDINANCE NO. 96 130
AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 16, SECTION 2-101(b),
HAWAII COUNTY CODE 1983, RELATING TO COMPENSATION FOR USE OF
PRIVATE AUTOMOBILE.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 2, Article 16, Section 2-101(b), Hawaii
County Code 1983, is amended to read as follows:
(b) Rate. [All officers and employees of the
County including council members; shall be entitled
to mileage allowance at rates equal to the highest
rates payable to any County employee in a
bargaining unit.] Employees who are excluded from
the various bargaining units shall be paid the same
rates provided for in negotiated contracts of
oargalning units that these employees would have
belonged to had they not been excluded. All oth
officers and employees of the County not covered
collective bar aining including County council
mem ers shall a entitled to mileage reimburseme
at a rate equal to the highest rate payable to a
County employee in a bargaining unit.
SECTION 2. Severability. If any provision of this
ordinance, in the application thereof to any person or
circumstance, is held invalid, the invalidity does not affect
other provisions or applications of the ordinance which can be
given effect without the invalid provision or application, and to
this end the provisions of this ordinance are severable.
SECTION 3. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material and underscoring need not be included.
SECTION 4. This ordinance shall take effect upon its
approval.
