Y a ~..:~ Bill No. 21 a ORDINANCE NO. ~ X34 AN ORDINANCE AMENDING CHAPTER 3, ARTICLE 2, HAWAII COUNTY CODE 1983, RELATING TO ADVERTISING AND SIGNS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this ordinance is to control the use of temporary signs in the Kailua Village by providing for a permit process for temporary signs and its regulation thereof and to increase and establish the fees for sign permits for permanent and temporary signs. SECTION 2. Subsection 20 of Chapter 3, Article 2, Division 1, Section 3-53 Hawaii County Code 1983 is hereby amended to read as follows: "(20) "Temporary sign" means valance constructed of cardboard, wall board, with or without a fram a period not to exceed calendar year." any sign, banner, pennant, or cloth, canvass, light fabric, or other similar material, e, intended to be displayed for thirty calendar days[.] in a SECTION 3. Chapter 3, Article 2, Division 1, Section 3-56 Hawaii County Code 1983 is hereby amended to read as follows: "Section 3-56. Permit application; contents, fees. (a) To obtain a sign permit, the applicant shall file an application on forms furnished by the director. (b) An application shall include the director's forms and two copies each of: (1) A graphic, colored illustration of the proposed sign, drawn to scale and reflecting all letters and the style and size of lettering. (2) A description and sample of any type of material to be used for the sign and its background, and a description of the method of any lighting. (3) A plot plan illustrating the location of the building or site and the location of the proposed sign. (c) A fee of [$5] $20 shall be submitted with each sign permit application. (d) A fee of $l0 shall be submitted with each temporary sign permit ap7i~-ion. ' SECTION 4. Chapter 3, Article 2, Division 2, Section 3-73 Hawaii County Code 1983 is hereby amended to read as follows: "Section 3-73. Number of signs. (a) Only one sign for any business or one sign for any street or vehicular access on which a building has frontage shall be permitted. (b) In a multi-building complex, a directory sign or a sign for the complex may be allowed which shall not be computed into the aggregate signing. (c) Temporary signs may also be allowed and shall not be computed into the aggregate signing." SECTION 5. Chapter 3, Article 2, Division 2, Section 3-78 Hawaii County Code 1983 is hereby amended to read as Follows: "Section 3-78. Exempt signs. (a) This article shall not apply to any: (1) Real estate sign not exceeding four square Peet in area and not containing any self-illuminated, luminescent, or fluorescent features; provided that only two signs are permitted on any lot. (2) Residential identification sign not exceeding two square feet in area. (3) Construction sign not exceeding twelve square feet in area; provided that only one sign is permitted on any lot. (4) [Temporary, informational sign] Informational signs, motion picture posters, or special events posters which conforms to the guidelines of section 3-58, and [is] are posted for a period no longer than thirty days[.] in a calendar year. -2- (5) Traffic control or other sign designed and intended for the direction, safety, or convenience of the public, authorized or initiated by the chief engineer of the County, and traffic control devices prescribed by chapter 291C, Hawaii Revised Statutes. (6) Reasonable application upon the glass surface of a door or window of lettering or decals giving the address, hours of operation, entrance or exit information, professional or security affiliations or memberships, credit cards which are accepted, or other similar information. (7) Official notice or sign posted by order of any court or public office, or posted by any public officer in the performance of a public duty, or posted by any person required to do so by any statute or ordinance or regulation having the force of law. SECTION 6. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need not be included. SECTION 7. In the event that any portion of the ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 8. This ordinance shall take effect upon its approval.
