AN ORDINANCE AMENDING CHAPTER 25, ARTICLE 24, OF THE HAWAII COUNTY
CODE 1983, RELATING TO THE KAILUA VILLAGE SPECIAL DISTRICT AND
URBAN DESIGN REVIEW COMMISSION.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 25, Article 24, is amended by amending
the title to read:
"Article 24. [Kailua Village Special District
and Urban Design Review Commission] Kailua Village
Design Commission."
SECTION 2. Chapter 25, Article 24, Section 25-266(a) is
amended to read as follows:
"(a) The [urban design review] desi n
commission shall consist of [fourteen nine members
who shall be appointed by the mayor with the
approval of the council. The members shall be
representative of the Kona District, provided that
a [minimum of fifty percent or seven] majority of
the appointive members shall have lived or worked
in the Kailua Village for a minimum of two years
prior to this appointment. The commission shall
also reflect a cross-section of labor, business
including tourism and agriculture, and the
Village's property owners interests. There shall
also be at least one person with a design
background and one person with a historical
knowledge background on the commission."
SECTION 3. Chapter 25, Article 24, Section 25-266(b) is
amended to read as follows:
"(b) The members shall serve staggered terms
of [four] three years, provided that of the first
members appointed[,] following the effective date
of this ordinance, (seven shall serve for four
years and seven shall serve for two years] three
shall serve for one year, three for two years, and
three for three years. When the term of a member
expires, he shall continue to serve until his
successor is appointed. Members whose terms expir
may not be reappointed to t- emission for at
least two years, however, members initially
pointed for one year may be reappointed for an
additional term without the passage of two years
SECTION 4. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material, and underscoring need not be
included.
SECTION 5. This ordinance shall take effect upon its
approval.
SECTIUN 6. Severability. If any provision of this ordinance
or the application thereof to any person or circumstance is held
invalio, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without
the invalid provision or application, and to this end, the
provisions of this ordinance are declared to be severable.
