HomeMy WebLinkAboutORD 1987-057 1984-1988COUNTY OF HAWAII , . ;:STATE OF HAWAII Bill No. ORDINANCE NO. 87 57 358 AN ORDINANCE AMENDING CHAPTER 18, ARTICLE 1, DIVISION 2, HAWAII COUNTY CODE 1983, RELATING TO THE COUNTY TRANSPORTATION COMMISSION. BE IT ORDAINED Bx THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 18, Article 1, Division 2, Hawaii County Code 1983, is amended to read as follows: "Section 18-3. Membership. There shall be a county transportation commission composed of nine commissioners, one for each council district and three at-large [, with alternating two year terms]. Commissioners shall be appointed by the mayor with the approval of the council and may be removed by the mayor with the approval of the council. Commissioners shall serve staggered terms of five years, one member to be appointed to a term of one Year, two for a term of two years, two for a term of three years, two for a term of four years, and two for a term of five years. No member shall be eligible for a second appointment to the commission prior to the expiration of two years, provided that members of the commission initially appointed for a term of one year and two years shall be eligible to succeed themselves for an additional term. Section 18-4. Director of finance as chief administrator. The director of finance shall be the chief administrator and he may assign any clerk, stenographer, agent or other assistant from the department of finance to the commission as may be necessary and define their powers and duties. Section 18-5. Commissioner's powers and duties. The commission shall have general supervision over carriers and shall perform the duties and exercise the powers imposed or conferred upon by division 3 of this article. In addition, the commission may serve as an advisory body to the Mass Transportation Agency and, upon request of the mayor or council, advise on other transportation-related matters." SECTION 2. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTION 3. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. -2- SECTION 4. Effective date. This ordinance shall take effect upon its approval.
