AN ORDINANCE ESTABLISHING THE NUMBER AND kATES OF COMPENSATION FOR ALL
POSITIONS IN llEPARTMENTS, OFFICES AND OTHER AGENCIES OF THE CUUNTY OF
HA4JAII UNDER THE LEGISLATIVE CONTROL OF THE COUNTY COUNCIL, DESIGNATING
FAYROLL PERIGDS, PAY DAYS, PRESCRIBING CERTAIN REQUIREMENTS WITH RESPECT
TO UVERTIh]E, PERQUISITES AND OFFICIAL FIDELITY BGNDS, AND REPEALING
ORllINANCE 86-65, AND ALL AMENDMENTS THERETO; SAID ORDINANCE TG BE KNOWN
AS THE SALARY ORDINANCE OF 1987.
BE IT ORDAINED BY THE CCUN'IY COUNCIL OF THE CUUNTY OF HAWAII:
SECTION 1. Declaration of policy. It is the purpose of this
ordinance to fix and establish the numner and rates of compensation for
all positions in departments and offices of the County of Hawaii under
the legislative control of the County Council pursuant to the provisions
of Section 3-14, County Charter, and chapters 76 and 77 of the Hawaii
Revised Statutes. This ordinance also covers other matters relating to
compensation of county employees. The term "Employees" as used in this
ordinance shall include all officers.
SECTION 2. Fayroll periods; pay days; fractional computation. Ali
salaries and wages shall be earned and payable in semi-monthly payroll
periods, from the first (1st) to the fifteenth (15th) of each month and
from the sixteenth (16th) to the end of each month;
The frfteentn (15th) day and last day of each month shall be the pay
days for all employees;
In the case where the required service has Deem rendered during a
full month, one-half (1/2) of the monthly rate shall be paid at the emu
of each payroll period;
The Director of Finance shall be authorized to approve payroll
clai;ns covering compensation for fractional parts of a month computed
otherwise than in accordance with the foregoing requirements, in cases
where corspliance with such requirements would result in hardship or
unfairness to the employees involved.
SEC'PION 3. Rate of compensation. (A) The monthly rates of
compensation for positions covered by the position classification plan
shall ~e based on the salary schedule, wage board salary schedule and
excluded managerial schedule as determined and fixed in accordance with
collective bargaining Agreements and all applicable laws thereto.
(B) Employees occupyiny positions not subject to the compensation
schedule set forth in subparagraph (A) hereinabove shall be paid at rates
of compensation set forth in the following schedule at the pay grade
fixed and established by Section 8 of this ordinance or any amendatory
resolution:

(F) Except as otherwise provided by ordinance, the 17ayor and the Council
shall review and compensate officers and exempt employees at an
appropriate step within a salary range on the same basis as employees of
bargaining units; provided, however, review and compensation shall be
based on assuring a sensible relationship and attracting and retaining
competent persons for county service, establishing and maintaining a high
level of efficiency of such persons and adequately compensate them for
the work they do.
SECTION 4. Employment governed by budget and appropriation.
Employees to fill the positions enumerated herein are to be employed as
needed and as specified in the respective applicable department budgets
approved for the year, or in ordinances or resolutions supplemental
thereto, to the extent that funds are available and appropriated by the

County Council as provided by law; provided, however, that an additional
employee may be appointed on a temporary basis to fill any of the
positions enumerated herein during the period that the employee who holds
the position is on a long-term leave of absence due to illness, injury,
or otherwise, provided that funds are available and appropriated by the
County Council as provided by law.
SECTION 5. Emergency employment. ~4hen an emergency exists in the
opinion of the Mayor, and additional labor or service, not provided for
by this ordinance, is needed by the county to care for such emergency,
the Mayor is authorized to appoint to a position or employment with the
county any such person or persons as he deems necessary at rates within
the ranges of compensation prescribed 'Herein, which are comparable to the
rates established hereunder in view of the labor or service to be
performed, to care for such emergency; provided, however, that no person
shall be so appointed unless at the time of appointment of such persons
there shall be available legally expendable funds sufficient for his
compensation. In the event the P7ayor appoints any person or persons to
positions or er.~ployment under this section he shall report the same to
the County Council at its next regular meeting.
SECTIOt] 6. Perquisites. That, pursuant to provisions of
Section 77-16, Hawaii Revised Statutes, each department head shall
determine, subject to the approval of the Mayor and under such directives
as he may issue, the reasonable value of allowance rendered to employees
in the form of quarters, heat, light, household equipment, and maid
service, laundry service or other perquisites at the expense of the

county but not for the convenience or benefit of the county and cause the
reasonable value of such allowances to be deducted from the compensation
of such employees. The department shall notify the employees concerned
of its findings and transmit the same to the Director of Personnel and
the Director of Finance.
SECTION 7. Official fidelity bonds. Pursuant to the provisions of
Sections 62-7 to 62-9, Hawaii Revised Statutes, and any act amendatory
thereto, or any provision passed in pursuance thereto by the County
Council, official fidelity bonds, filed and approved in the form and
manner set forth in Sections 46-26 and 46-28, Hawaii Revised Statutes,
shall be required of the persons appointed to or occupying certain
positions enumerated in the above sections; said bonds shall be in the
custody of the Director of Finance, excepting the bond of the Treasurer
whici~ shall be in the custody of the t7ayor.
SECTION 8. That all positions in departments and offices of the
County of Hawaii under the legislative control of the County Council of
the County of Hawaii be and the same are hereby fixed and established as
follows:

SECTION 9. The positions and rates of compensation adopted in the 1987
budget of the County of Hawaii are hereby ratified and confirmed as of
July 1, 1987; and that any creation, reallocation of positions, salary range
reassignment or other changes of pay subsequent to the adoption of said
budget, shall take effect as authorized on the date of such creation,
reallocation, salary range reassignment or change of pay or a date otherwise
prescribed, subject to the certification of availability of funds by the
Director of Finance.
SECTION 10. Ordinance 86-65 and any resolutions amendatory thereto are
hereby repealed.
SECTIOP7 11. The repeal of the ordinance, enumerated in Section 10
above, shall not affect any act done, ratified or confirmed, or any right
accruing and accrued or established, or any action, suit or proceedings had
or commenced in any several cause prior to said repeal, but all rights and
liability under said ordinance hereinabove repealed shall continue and may be
enforced in the same manner and with the same force as if said repeal had not
been made.
SECTION 12. Severability. If any section, or any part or clause of any
section, of this ordinance be decided by the Courts to be unconstitutional or
invalid, the same shall not affect the validity thereof which can be given
effect without that so decided to be unconstitutional or invalid.

SECTION 13. This ordinance shall be known as the Salary Ordinance
of 1987 and shall take effect as of July 1, 1987.
