AN ORDINANCE AMENDING THE COUNTY OF HAWAII GENERAL PLAN AS
ORIGINALLY ADOPTED BY ORDINANCE N0. 439 AND AS AMENDED BY
ORDINANCE NOS. 456, 475, 484 and 538.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The County of Hawaii General Plan Land Use
Pattern Allocation Guide Map is hereby amended to redesignate
approximately 314 acres of land, identified by Tax Map Key
7-3-09:04, located at Ooma 2nd, North Kona, Hawaii from
Conservation and Open to Resort, Industrial, Alternate Urban
Expansion and Open designations.
SECTION 2. The County of Hawaii General Plan Land Use
element is hereby amended to include Ooma 2nd as an
Intermediate Resort area.
SECTION 3. The changes in designation are subject to the
following conditions: (A) that employee housing and a range of
residential opportunities be provided on-site or off-site if
required; (B) that the Petitioner shall be responsible for
providing all on-site infra-structural requirements and
improvements; and where possible shall consider joint systems
with neighboring developments; (C) that the Petitioner shall
participate in a joint water quality monitoring system with
NELH and HOST projects; (D) the Petitioner shall work with the
State Department of Transportation, Airports Division, and the
County of Hawaii Planning Department to assure that site design
and plans are compatible with airport-related uses of Keahole
Airport; and (E) the Petitioner shall coordinate with the
County of Hawaii Planning Department plans for the provision of
public access to the shoreline.
SECTION 4. If any provision of this ordinance or the
application thereof to any person or circumstance is held
invalid, the invalidity shall not affect other provisions or
applications of this ordinance which can be given effect
without the invalid provision or application, and to this end
the provisions of this ordinance are severable.
SECTION 5. This ordinance shall take effect upon its
approval.
