AN ORDINANCE TEMPORARILY PERMITTING THE CONSUMPTION OF ALCOHOLIC
BEVERAGES IN A DOWNTOWN HILO PAkKING LOT ON AUGUST 7, 1987,
BETWEEN THE HOURS OF 12:00 NOON AND 7:00 P. M.
bE IZ` ORDAINED BY THE COUNCIL CF THE COUNTY OF HAWAII:
SECTION 1. Notwithstanding any, law to the contrary,
intoxicating liquor dispensed by a non-profit organization
designated by the mayor may be consumed in that portion of the
Downtown Parking Lot, excepting all sidewalk areas, bounded by
Kamehameha Avenue, Haili Street and a line in the Hamakua direction
parallel to and one hundreu feet from Haili Street on August 7,
1987, between the hours of 12:00 noon and 7:00 p.m., provided:
1. T'tie non-profit organization so designated by the mayor of
the County of Hawaii to dispense intoxicating liquor for consumption
on the premises shall provide security for the above-designated area
by:
(A) Erecting, with the approval of the chief of police or his
designated representative, a fence or other physical barrier
encircling the consumption area and leaving one opening in the
barrier for an entrance-exit point.
(B) Employing sufficient personnel to:
(i) Maintain orderly behavior within the enclosed area in
whicY, intoxicating liquor may be dispensed and consumed; and
(ii) Prevent tk~e entry into the above-mentioned enclosed area
of any person who is under the influence of intoxicating liquor or
who is in possession of intoxicating liquor; and
(iii) Prevent the exit from the above-mentioned enclosed area
of persons in possession of intoxicating liquor.
2. The non-profit organization shall obtain liability
insurance coverage and shall provide the County with a certificate
of insurance coverage, naming the County as additional insured, for
bodily injury liability coverage of no less than $300,000 per person
and property damage of $100,000.
3. No intoxicating liquor shall be dispensed for consumption
on the above-designated premises to arty person who is under the
influence of intoxicating liquor nor to any person under twenty-one
years of age.
SECTION 2. If any provision of this ordinance or the
application thereof to any person or circumstance is held invalid,
such invaliaity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 3. This ordinance shall take effect upon its approval.
