ORDINANCE NO. 8~ 34
AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 1, SECTION 24-2, AND
CHAPTER 24, ARTICLE 8, DIVISION 6, SECTIONS 24-243 and 24-245,
HAWAII COUNTY CODE 1983, RELATING TO PARKING PERMITS FOR DISABLED
PERSONS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION i. Chapter 24, article 1, section 24-2, Hawaii
County Code, is amended to read as follows:
"Section 24-2. Scope and applicability of chapter. The
provisions set forth in this chapter are to provide for the
regulation of traffic upon the public streets of the County, [and]
such private streets, highways and thoroughfares which have been
continuously used by the general public for more than five
years[.], and such private properties which have been designated
and identified as a special parking stall for disabled persons
scant to sectiun 24-243."
SECTION 2. Chapter 24, article 8, division 6,
section 24-243, Hawaii County Code, is amended to read as follows:
"Section 24-243. [Chief engineer to designate special
stalls.] Designation of special stalls. The chief engineer is
hereby authorized to designate and identify special parking stalls
for disabled persons in areas under the jurisdiction of the.
County. In addition, private property owners may also designate
and icientify special parking stalls for disabled persons on their
property. The existence of such special parking stalls on private
roperty shall continue until terminated by the owner. All
special parking stalls for disabled persons shall conform to the
ifications established by the chief engineer."
SECTION 3. Chapter 24, article 8, division 6,
section 24-245, Hawaii County Code, is amended to read as follows:
"Section 24-245. Penalties for violations.
(a) Non-compliance with any provisions of this division by
placard holders shall constitute sufficient grounds for the
immediate suspension of,special parking privileges, for a period
not exceeding six months, or for the revocation of all privileges
herein granted, for a period of not less than one year, subject to
the determination of the director of finance.
(b) Any vehicle parked in or obstructing a special parking
stall designated for disabled persons without complying with the
requirements of this division will be towed away at the owner's
expense. Notwithstanding any provision to the contrary, the
private owner of property may take all steps available to him
under law to remove an unlawfully parked vehicle from its premises.
(c) Any person convicted of parking a vehicle in or
obstructing a stall designated for disabled persons without
complying with the requirements of this division shall be punished
by a fine of not more than $500."
SECTION 4. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the

includes.
SECTION 5. If any provision of this ordinance or the
application thereof to any person or circumstance is hell invalid,
such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 6. This ordinance shall take effect upon its
approval.
