BI[~ W0. 431 (DRAFT 3) ORDINANCE NO 87 122 AN ORDINANCE AMENDING CHAPTER 4, ARTICLE 4, DIVISION 2, OF THE HAWAII COUNTY CODE 1983, RELATING TO ANIMALS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this ordinance is to amend the provisions of the Hawaii County Code by making the penalties for violations of failing to confine vicious dogs more stringent. SECTION 1. Chapter 4, article 4, section 4-31, of the Hawaii County Code 1983, is amended to read as follows: "Section 4-31. Confinement of vicious dogs. (a) Every vicious dog shall be confined by the owner within a building or secure enclosure and shall be securely muzzled or caged whenever off the premises of its owner. (b) [There shall be a penalty of S25 for each violation of this section.] Any person found guilty of violating this section may be fined not more than $1,000 or imprisoned for not more than thirty days, or both. The minimum sentence to be imposed upon a person found guilty of violating this section shall be as follows: (1) For a first conviction, a fine of not less than $100, but not more than X1,000. (2) For a second conviction which occurs within five nears of a prior conviction under this section, a fine of not less than 5500, but not more than X1,000. (3) For a third conviction which occurs within five years of two prior convictions, a fine of not less than $1,000. No fine imposed on a person found guilty of violating this section shall be suspended." SECTION 3. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need not be included. SECTION 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable.
