HomeMy WebLinkAboutORD 1987-128 1984-1988,~~ COUNTY OF HAWAI~=ESTATE OF HAWAII ~:._ BI~~ W0. 435 ORDINANCE NO. 87 128 AN ORDINANCE AMENDING THE COUNTY OF HAWAII GENERAL PLAN AS ORIGINALLY ADOPTED BY ORDINANCE NO. 439 and AS AMENDED BY ORDINANCE NOS. 456, 475, 484, 538, 822, 854, 868, 878, 83-20, 84-40, 87-49, 87-52 and 87-68. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The County of Hawaii General Plan Land Use Pattern Allocation Guide Map is hereby amended to redesignate approximately 349+ acres of land, identified by Tax Map Key 7-2-04:03 located at Awake'e, North Kona, Hawaii from Conservation and Open to Resort, Medium Density Urban and Open Area designations. SECTION 2. The County of Hawaii General Plan Land Use element is hereby amended to include Awake'e as an Intermediate Resort area. SECTION 3. The changes in designation are subject to the following conditions: (A) employee housing and a range of residential opportunities shall be provided by the Petitioner, its successors or assigns either on- or off-site as required; (B) that the Petitioner, its successors or assigns shall be responsible for the development of the necessary water source and transmission infra-structure to provide an adequate supply of potable water for the proposed project; (C) the Petitioner, its successors or assigns, in coordination with State and County agencies, shall participate in a water quality monitoring program encompassing offshore coastal waters and the on-site anchialine ponds; (D) the Petitioner, its successors or assigns shall obtain approval for the Queen Ka'ahumanu Highway access point and rights-of-way over state-owned lands from appropriate State agencies; (E) the Petitioner, its successors or assigns shall work with the State Department of Transportation to monitor traffic conditions and coordinate roadway improvement plans. All, intersection improvement costs shall be borne by the Petitioner; (F) the Petitioner, its successors or assigns shall prepare an anchialine pond management plan in consultation with appropriate Federal, State and County agencies prior to submittal for rezoning and shoreline management area permits; (G) the Petitioner, its successors or assigns shall prepare, in coordination with appropriate State and County agencies, an archaeological resources management plan; (H) the Petitioner, its successors or assigns shall provide public access to and along the coastline and related improvements; and (I) that Pu'u Kuili from the 200-foot contour shall be retained in the Open designation. SECTION 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, the invalidity shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 5. This ordinance shall take effect upon its approval.
