ORDINANCE NO. 88 ~
AN ORDINANCE AMENDING CHAPTER 24, ARTICLE. 2, OF THE HAWAII COUNTY
CODE 1983, RELATING TO TRAFFIC CODE ADMINISTRATION.
BE IT ORDAINED BY THE COUNCIL OF ThE COUNTY OF HAWAII:
SECTION 1. Chapter 24, article 2, section 24-8, of the
Hawaii County Code 1983, is amended to read as follows:
"Section 24-8. Council to exercise certain functions by
ordinance.
(a) The council shall by ordinance:
(1) Determine and designate the type of all official
traffic control devices; provided, such official control devices
shall, with respect to size, shape, and color, be uniform, shall
correlate with and conform to the system then current, as approved
by the [American Association of State Highway Officials.] Federal
Highway Administration, U. S. Department of Transportation
(2) Create, define, redefine, eliminate, or change all
safety zones, quiet zones, crosswalks other than at intersections,
freight and passenger loading and unloading zones, no-parking
zones, time-limit parking zones, U-turn areas, prohibited U-turn
areas, prohibited left and right turns, one-way streets, through
streets, stop intersections, roadways closed to pedestrian
traffic, and roadways closed to certain classes of vehicles."
SECTION 2. Chapter 24, article t, section 24-9, of the
Hawaii County Code 1983, is amended to read as follows:
"Section 24-9. Maintenance of signals by chief engineer and
district engineer.
(a) Subject to section 24-8, the chief engineer is
authorized, and as to those devices, signs, signals, and markings
required for the purpose of traffic control, it shall be his duty
to place and maintain or cause to be placed and maintained all
official traffic control devices, signs, signals and markings.
(b) Subject to section 24-8, the district engineer
shall, on State maintained highways, place and maintain official
traffic control devices, signs, signals and markings consistent
with standards approved by the [American Association of State
Highway Officials.] Federal Hi hway Administration
U. S. Department of Transportation
(c) All devices, signs, signals and markings required
for the purpose of traffic control shall be uniform as to type and
location throughout the County."
SECTION 3. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material, and underscoring need not be
included.
SECTION 4. If any provision of this ordinance or the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications

of the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its
approval.
