ORDINANCE NO. 88 5'7
AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 26, SECTIONS 2-148 AND
2-149 OF THE HAWAII COUNTY CODE 1983, RELATING TO SALARY
ADVANCEMENT WITHIN PAY GRADES IN THE OFFICE OF THE PROSECUTING
ATTORNEY AND IN THE OFFICE OF THE CORPORATION COUNSEL.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The purpose of this ordinance is to
amend sections 2-148 and 2-149 of the Hawaii County Code by
removing the restrictions placed upon the advancements which a
deputy prosecuting attorney or deputy corporation counsel may make
within the LG-1 and LG-2 pay grades in the first year of the
deputy's employment. Under this ordinance, the prosecuting
attorney and the corporation counsel will have greater discretion
in advancing deputies' salaries and will be allowed to base
changes in salary upon merit and office guidelines rather than
being limited by a calendar.
SECTION 2. Chapter 2, article 26, section 2-148 is amended
to read as follows:
"Section 2-148. Advancement within grade.
(a) Law Grade 1 - A deputy may be advanced one step within
grade after having completed a six-month period of initial
employment with the County. [A deputy may be advanced not more
than three subsequent steps within grade upon having completed a
LA/HAT
one-year period of employment in the step from which the deputy is
advancing.] Thereafter, upon completion of subsequent six-month
periods of employment, a deputy may be advanced one step within
grade or not more than two subsequent steps within grade in a
one-year period.
(b) Law Grade 2 - A deputy may be advanced one step within
grade after having completed a [one-year] six-month period of
employment in the step from which the deputy is advancing or not
more than two subsequent steps within grade in a one-year eriod.
(c) Advancement within grade is at the discretion of the
appointing authority and shall be based upon merit principles and
governed by the guidelines adopted pursuant to this article."
SECTION 3. Chapter 2, article 26, section 2-149 is amended
to read as follows:
"Section 2-149. Guidelines for advancement within grade and
supervisory placement.
(a) The appointing authority shall adopt guidelines setting
out the following:
(1) The criteria or conditions that must be met before a
deputy may be advanced initially after having completed a
six-month period of initial employment or one step within grade in
any [one-year] six-month period.
(2) The criteria or conditions that must be met before a
deputy may be advanced more than one step within grade in any
one-year period.

(3) The responsibilities and duties that must be performed
by any supervising deputy placed in or advanced to any step within
the supervisory grade."
SECTION 4. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material, and underscoring need not be
included.
SECTION 5. If any provision of this ordinance or the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 6. This ordinance shall take effect upon its
approval.
