AN ORDINANCE AMENDING ORDINANCE NO. 87-59, AS AMENDED, RELATING
TO PUBLIC IMPROVEMENTS AND FINANCING THEREOF FOR THE FISCAL YEAR
JULY 1, 1987, TO JUNE 30, 1988.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. It is the purpose of this ordinance to
appropriate funds for the projects listed herein, provided that
none of the funds shall be used to pay for salaries, wages, or
consultation contracts without approval of the county council.
The projects shall be funded solely and entirely by revenues
derived from the increased fuel tax created by Resolution 397-88.
SECTION 2. Ordinance No. 87-59, relating to public
improvements and financing thereof for the fiscal year July 1,
1987, to June 30, 1988, is hereby amended by adding the following
projects:

SECTION 3. Funding shall be distributed among the districts
in accordance with a district apportionment formula which takes
into account the percentage of vehicle weight taxes collected and
percentage of road miles in each district. The distribution
formula used for this exhibit is as follows:

Approximately X15 million will be generated by the fuel tax
increase over the ten-year period.
SECTION 4. Funds for these projects shall be provided from
that portion of the Highway Fund which is designated as the Fuel
Tax Increase account, No. 3104.06, and which consists of the
increased fuel tax revenues created pursuant to Resolution 397-88.
SECTION 5. If any provision of this ordinance or the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECT.IGN 6. This ordinance shall take effect upon its
approval.
