ORDINANCE NO. 88 94 AN ORDINANCE AMENDING CHAPTER 25, ARTICLE 1, DIVISION 7, SECTION 25-46 OF THE HAWAII COUNTY CODE 1983, RELATING TO SUPPLEMENTARY USE REGULATIONS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this amendment is to allow temporary real estate offices and model homes to be located in residential zones within the County. SECTION 2. Chapter 25, article 1, division 7, section 25-46 is amended to-read as follows: SSR "Section 25-46. [Reserved] Temporary Real Estate Offices and Model Homes. Temporary real estate offices and model homes shall be permitted in the RS, RD, and RM zones for new residential developments, subiect to the following conditions: (a) The development must consist of 6 or more lots and/or ~,.,; ~~ (b) The temporary real estate office or model home use shall not exceed a period of 24 months from the date of official approval by the planning director. Time extensions may be granted by the planning director. (c) If the temporary real estate office is established in a structure not otherwise permitted ticular zoned district, the structure shall be removed co-terminous with the expiration of the temporary real estate office use. The temporary real estate office or model home shall be used exclusively for marketing of lots and/or units located within the development in which it is to be located. In multi-phased developments, a temporary real estate office or model home may be allowed for each development phase for a period not to exceed 24 months. Time extensions may be granted by the planning director. (e) Parking for the temporary real estate office use shall be based on a minimum of one parking stall for each employee and a minimum of one parking stall for each 400 square feet of gross floor area. The parking requirement may be satisfied off-site, ovided that approval is secured from the planning director. (f) The temporary real estate office or model home shall comply with the minimum setback and height requirements of the particular zone district. Final approval for the subdivision shall be granted from the planning director prior to establishment of the temporarv real estate office or model home. Plan approval shall be secured from the planni director prior to the establishment of the temporary real estate office or model home." SECTION 3. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need not be included. SECTION 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, -2- such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 4. This ordinance shall take effect upon its approval.
