AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 7, DIVISION 2, OF THE
HAWAII COUNTY CODE 1983, RELATING TO SPEED RE~iULATIONS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 24, article 7, division 2,
section 24-149, of the Hawaii County Code 1983, relating to
maximum speed limits, is amended to read as follows:
"Section 24-149. Maximum speed limit.
(a) The following maximum speed limit shall be in effect
except where a special speed limit has been enacted:
(1) Twenty-five Miles per Hour.
(A) When passing a school site or the grounds
thereof, which are contiguous to, or located in close proximity
to, the highway and posted with the standard 'school' warning
sign while children are going to be leaving the school during
opening or closing hours. This speed limit shall also apply
during school recesses when passing any school grounds which are
not separated from the highway by a fence or other physical
barrier capable of restraining a child, while the grounds within
seventy-five feet of the highway are in use by a child, and the
highway is posted with the standard 'school' warning sign.
(B) During school days for a distance of up to
one thousand feet on both sides of a crosswalk designated by the
Chief Engineer as a School Crossing and posted with the standard
School Crossing.'
(C) In a residential district, except for the
streets in South Hilo as described in schedules 6 and 9,
sections 24-258 and 24-261.
(D) On all hiohwavs and streets unless otherwise
specified by this chanter.
(2) Thirty-five Miles per Hour. In a business
district.
[(3) Fifty-five Miles per Hour. On all highways
unless otherwise specified by this chapter.]"
SECTION 2. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material, and underscoring need not be
included.
SECTION 3. If any provision of this ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without
the invalid provision or application, and to this end, the
provisions of this ordinance are declared to be severable.
