COUNTY OF HAWAII ;STATE OF HAWAII Bill No. l a y ORDINANCE NO. ~© ®05 AN ORDINANCE AMENDING CHAPTER 15, ARTICLE 7 OF THE HAWAII COUNTY CODE 1983, RELATING TO THE VETERAN'S ADVISORY COMMITTEE. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this bill is to increase the membership of the Veteran's Advisory Committee from thirteen to fifteen members and to include on the committee representatives of two new veteran organizations: (1) the Big Island National Guard Retirees Association; and (2) the Special Forces Association. In addition, nonsubstantive amendments have been made to improve clarity. SECTION 2. Chapter 15, article 7, section 15-61, Hawaii County Code 1983, as amended, is amended to read as follows: "Section 15-61. Organization. There shall be a committee composed of [thirteen] fifteen members, who shall be appointed by the Mayor and confirmed by the Council. Any member of the committee may be removed [upon a consideration of] ~ the Mayor [and] with the approval of the Council." SECTION 3. Chapter 15, article 7, section 15-62, Hawaii County Code 1983, as amended, is amended to read as follows:. "Section 15-62. Membership and tenure. (a) The members shall serve staggered terms of five years. (b) The membership of the committee shall include one representative each from the American Legion, Big Island National Guard Retirees Association, Big Island Retired Military Association, Club 100, Disabled American Veterans, Fleet Reserve Association, 442nd Veterans Association, Hilo Interpreters Club, Special Forces Association, Veterans of Foreign Wars, and the Veterans of the Vietnam War. (c) Initially, two members shall be appointed for a term of one year, two members shall be appointed for a term of two years, three members shall be appointed for a term of three years, three members shall be appointed for a term of four years, and three members shall be appointed for a term of five years. (d) Any vacancy on the committee shall be filled for the remainder of the unexpired term, but members whose terms have expired may continue to serve until their successors have been appointed and confirmed. (e) No member shall be eligible for a second appointment to the committee prior to the expiration of two years, provided that members initially appointed for a term of one or two years shall be eligible to succeed themselves for an additional term. (f) [In addition, the] The Hawaii Island Veterans Affairs Advisor (Department of Social Services of the State of Hawaii) and the director of the department of Darks and recreation, or their designates, shall be ex-officio members of the committee. -2- (q) The first term of the representative from the Big Island National Guard Retirees Association shall expire on December 31 1993. The first term of the representative from the ~ecial Forces Association shall expire on December 31, 1992. Thereafter successors to these representatives shall be appointed for a term of five years." SECTION 4. Material to be deleted is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need not be included. SECTION 5. If any provision of this ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 6. This ordinance shall take effect upon its approval.
