AN ORDINANCE AMENDING CHAPTER 25, ARTICLE 1, DIVISION 3 OF THE
HAWAII COONTY CODE 1983, AS AMENDED, RELATING TO NONSIGNIFICANT
ZONING AMENDMENTS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAFIAII:

SECTION 1. Purpose. The purpose of this amendment is to allow
nonsignificant zoning changes to be approved administratively by the
Planning Director as provided for in Section 46-4.2, Hawaii Revised
Statutes.
SECTION 2. Chapter 25, Article 1, Division 3 of the Hawaii
County Code 1983 is amended by adding a new section to be
appropriately designated and to read as follows:
"Section 25- Nonsignificant zoning changes. (a) The
planning director may administratively grant nonsignificant zoning
change , which is defined as a change in district classification 1)
which does not result in an increase or decrease in any zoning
designation affecting more than five percent or one acre of any
parcel of property, whichever is less, and 2) which is in compliance
with the general plan and development plan designations of the
property (b) The director shall promulgate rules in compliance
with HRS chapter 91 to carry out this section of the law."
SECTION 3. New material is underscored. In printing this
ordinance, the underscoring need not be included.
SECTION 4. If any provision of this ordinance or the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications of
Lhe ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 5

This ordinance shall take effect upon its approval.
