ORDINANCE NO. 9Q 92
AN ORDINANCE TO INITIATE A CHARTER AMENDMENT AMENDING ARTICLE X,
SECTION 10-2(a), HAWAII COUNTY CHARTER 1980, RELATING TO THE
PREPARATION AND SUBMISSION OF THE BUDGET AND CAPITAL PROGRAM.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Article X, section 10-2(a), Hawaii County
Charter 1980, is amended as follows:
"(a) [Within ten (10) working days after the close of the
state legislature but not later than May 1 of each year, the]
The mayor shall submit on or before March 1 of each year to the
county council:
(1) An operating budget for the ensuing fiscal year.
(2) An operating program for the ensuing three fiscal
years.
(3) A capital budget for the ensuing fiscal year.
(4) A capital program for the ensuing six fiscal
years.
(5) An accompanying message."
SECTION 2. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material, and underscoring need not be
included.
SECTION 3. If any provision of this ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without
the invalid provision or application, and to this end, the
provisions of this ordinance are declared to be severable.
SECTION 4. Upon adoption of this ordinance, this council,
by appropriate resolution, shall provide that this amendment be
submitted to the electorate of the county for approval at the
next general election.
