ORDINANCE NO. 99 93
AN ORDINANCE TO INITIATE A CHARTER AMENDMENT ALLOWING THE HAWAII
COUNTY COUNCIL TO EXECUTE CONTRACTS FOR SERVICES NECESSARY TO THE
COUNCIL'S LEGISLATIVE FUNCTIONS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The purpose of this amendment is to
allow the council to enter into contracts to obtain and pay for
services which are necessary to the council's carrying out of
legislative functions. The increasing complexity of the issues
facing the council, the increasing population of Hawaii County,
and the expansion of government services requires that the
county council be able to obtain such services.
SECTION 2. Article III of the Hawaii County Charter 1980
is hereby amended by adding a new section 3-18 which is to read
as follows:
SECTION 3-18 Contracts Necessary to Legislative
Functions The county council may contract for services
necessary to the exercise of its legislative powers. The
council chairperson shall execute the contract on behalf of the
council after the council has expressed by resolution the need
for such a contract Notwithstandino any provision of this
charter to the contrary the execution of the contract by the
council chairperson shall be sufficient to obligate the county
SECTION 3. Upon adoption of this ordinance, this council,
by appropriate resolution, shall provide that this amendment be
submitted to the electorate of the county for approval at the
next general election.
SECTION 4. New material is underscored. In printing this
ordinance, the underscoring need not be included.
SECTION 5. In the event that any portion of the ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
