AN ORDINANCE AMENDING SECTION 25-115 (PAPAIKOU-ONOMEA ZONE
MAP), ARTICLE 3, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY
CODE, RELATING TO MODIFICATIONS OF CONDITIONS B AND C OF
ORDINANCE N0. 86 111, WHICH RECLASSIFIED 14,142 SQUARE FEET OF
LAND FROM A SINGLE FAMILY RESIDENTIAL (RS-7.5) TO A VILLAGE
COMMERCIAL (CV-10) ZONED DISTRICT AT PAPAIKOU, SOUTH HILO,
HAWAII, COVERED BY TAX MAP KEY 2-7-33:15.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Ordinance No. 86 111 is amended as follows:
"SECTION 2. This change in district classification is
conditioned upon the following: (A) the applicant, successors
or assigns shall be responsible for complying with all of the
stated conditions of approval; (B) [plans of the proposed
development, including landscaping and parking, shall be
submitted for Plan Approval review within one year from the
effective date of the zone change) Final Plan Approval shall be
secured from the Planning Department within one year from the
effective date of this amendment. To assure adequate time for
plan approval review and in accordance with Chapter 25-244
(Zoning Code), plans shall be submitted a minimum of forty-five
days prior to the date by which plan approval must be secured;
(C) building permits for the rer.ovation[s to] of the existing
buildings to allow a change in occupancy from a residential to
commercial use shall be secured [commence] within one year from
the date of receipt of Final Plan Approval and be completed
(certificate of occuoancy~ within one year thereafter; (D) a
drainage system shall be installed meeting with the
requirements of the Department of Public Works; and (E) all
other applicable rules, regulations and requirements shall be
complied with. Should any of the foregoing conditions not be
met, rezoning of the area to its original or more appropriate
zoning designation shall [may] be initiated."
SECTION 2. Material to be deleted is bracketed. New
material is underscored.
SECTION 3. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
