HomeMy WebLinkAboutORD 1991-075 1988-1992(:b V #:^, }.T= COUNTY OF HAWA~~" t "`~;~TATE OF HAWAII ~'~'~~~ BILL NO. 44s ORDINANCE NO. ~ ~5 AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, OF THE HAWAII COUNTY CODE 1983, RELATING TO TRAFFIC REGULATIONS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 24, article 10, division 8, section 24-293, schedule 41, of the Hawaii County Code 1983, relating to use of certain streets by certain vehicles restricted, is amended by amending subsection (a) to read as follows: "(a) The following classes of vehicles are precluded from the use of the designated streets when appropriate signs giving notice thereof are erected: Vehicle with a capacity of three-quarters of a ton or over: (1) Pakalana Street between Lehua Street and Kukui Street in a northerly direction ezcept that any vehicle equipped with safety brakes consisting of an automatic spring that will actuate the brakes when the air pressure drops below sixty pounds per square inch may be operated during the hours when Honokaa High and Elementary School is not in session. All vehicles equipped with safety brakes shall first be checked and approved by the Chief Engineer of the Department of Public Works before they are operated on such street. The approval of the Chief Engineer shall be valid for a period of three months. (2) Waipio Valley Road in Hamakua from the top of the lookout to the bottom of the valley, restricted to four-wheel drive vehicles only. (3) Makai-bound traffic shall yield to mauka-bound traffic on the access road into Waipio Valley[, except at those areas designated by the Chief Engineer with regulation signs noting otherwise]." SECTION 2. Material to be repealed is bracketed. In printing this ordinance, the brackets and bracketed material need not be included. SECTION 3. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be sevdrable. SECTION 4. This ordinance shall take effect upon its approval.
