AN ORDINANCE AMENDING SECTION 25-90 (KAILUA-HONALO URBAN ZONE
MAP) ARTICLE 3, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY
CODE, BY CHANGING THE DISTRICT CLASSIFICATION FROM VILLAGE
COMMERCIAL (CV -10) TO OPEN (0) AT HOLUALOA 1 AND 2, NORTH KONA,
HAWAII, COVERED BY TAX MAP KEY 7-6-03:18.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-90, Article 3, Chapter 25 (Zoning
Code) of the Hawaii County Code, is amended to change the
district classification of property described hereinafter as
follows:
The district classification of the following area
situated at Holualoa 1 and 2, North Kona, Hawaii, shall be
Open (0):
Beginning at an old +, found, at the southeast corner of
this parcel of land, the coordinates of which referred to
Government Survey Triangulation Station "KAILUA" being
7,701.74 feet South and 15,734.58 feet East, and thence
running by azimuths measured clockwise from true South:
1. 730 30' 168.83 feet along Allotment 70 of
the Partition of the
Holualoa 1 and 2 Lands, to
a pipe in concrete;
2. 1840 40' 169.60 feet along the easterly
side of Mamalohoa Highway,
to a pipe in concrete;
3. 211° 10' 261.50 feet along the easterly
side of Mamalahoa Highway,
to a pipe in concrete;
4. 3570 53' 345.10 feet along the westerly
side of the old Government
Road, to the point of
beginning and containing
an area of 38,112 square
feet, or 0.875 acre.
All as shown on the map attached hereto, marked
Exhibit "A" and by reference made a part hereof.
SECTION 2. In the event that any portion of the ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 3. This ordinance shall take effect upon its
approval.
