ORDINANCE NO. 91 111
AN ORDINANCE AMENDING ORDINANCE NO. 91-51, AS AMENDED, RELATING TO
PUBLIC IMPROVEMENTS AND FINANCING THEREOF FOR THE FISCAL YEAR
JULY 1, 1991 TO JUNE 30, 1992.
WHEREAS, Bill 227, as originally introduced, proposed in part to
delete the appropriation of $110,000 for the South Point Road
Realignment--design, land acquisition project and to increase the
Kamaoa Road Safety Improvement project by $110,000; and
WHEREAS, Bill 227, Draft 3, enacted as Ordinance No. 90-49
reversed the proposed changes and kept the South Point Road
Realignment--design, land acquisition project at $110,000 and the
Kamaoa Road Safety Improvement project at $17,820; and
WHEREAS, Corporation Counsel has opined that capital improvement
project appropriations nor the funding source may be changed after
the fiscal year in which the capital budget has been appropriated
has passed; and
WHEREAS, the Council finds that the Kamaoa Road Safety
Improvement project warrants a higher priority consideration than
the South Point Road Realignment project.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Ordinance No. 91-51, Relating To Public Improvements
and Financing Thereof For The Fiscal Year July 1, 1991 to June 30,
1992 is hereby amended by increasing the appropriation for the
Kamaoa Road Safety Improvement project by $110,000.
SECTION 2. Funds for this appropriation increase shall be
provided from the fuel tax increase proceeds.
SECTION 3. This ordinance shall take effect upon its approval.
