ORDINANCE NO. 92 1-g
AN ORDINANCE CREATING ACCOUNTS FOR FUEL TAX FUNDS TO BE SPENT IN
INDIVIDUAL DISTRICTS OF THE COUNTY OF HAWAII.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII;
SECTION 1. Purpose. The purpose of this bill is to
provide a logical, fair and easy to administer financial plan
which will carry out the policy set forth in Resolution 351-91
(draft 2): "Fuel Tax Increase Expenditure Plan."
Each district will receive a district appropriation rather
than having each project receive an appropriation. This is
being done to overcome two shortcomings inherent with project
specific appropriations. Projects estimates may underestimate
or overestimate the cost of a project. When this happens, new
bills must be drafted and submitted which can be and usually is
a lengthy process, resulting in further construction delays.
District appropriations have the shortcomings of not being
project specific. To overcome this, the projects to be
completed in each district as well as those "circle island", or
around the island road projects, will be in accordance with the
prioritized district listing shown on Exhibits A and B,
respectively, which are attached hereto for information only.
SECTION 2. The following amounts to be encumbered in each
respective district prior to June 30, 1992 are hereby
appropriated and assigned to the accounts listed below:

The district amounts are derived from the tables contained
in Exhibit C, which is attached hereto for information only.
SECTION 3. Funds for these projects shall be provided from
that portion of the Highway Fund which is designated as the Fuel
Tax Increase account, No. 3104.06, and which consists of the
increased fuel tax revenues created pursuant to
Resolution 397-88.
SECTION 4. if any provision of this ordinance or the
application thereof to any person or circumstance is held

invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without
the invalid provision or application, and to this end, the
provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its
approval.
