ORDINANCE NO. 92 37
AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 7, OF THE HAWAII
COUNTY CODE 1983, RELATING TO PLANNING DEPARTMENT.
WHEREAS, on October 9, 1965, the Hawaii Redevelopment
Agency effectuated its Declaration of Restrictions Affecting
Redevelopment Sites in the Kaiko'o Project Designated for
Elevated Area Uses; and
WHEREAS, said declaration is the instrument by which the
Kaiko'o Project plan and its amendments were to be implemented;
and
WHEREAS, said declaration also provided for a compliance
period of thirty-five years; and
WHEREAS, on March 5, 1980, the Hawaii County Council
adopted Resolution 563 which reactivated the Hawaii
Redevelopment Agency to oversee the economic revitalization
program for downtown Hilo; and
WHEREAS, on June 5, 1985, the Hawaii County Council
adopted Resolution 59-85 approving the Downtown Hilo
Redevelopment Plan, dated February 1985; and
WHEREAS, effective June 30, 1990 the Hawaii
Redevelopment Agency was deemed to be deactivated due to
discontinued funding for the fiscal year 1990-1991; and
WHEREAS, both the Kaiko'o Project and the Downtown Hilo
Redevelopment plans require continued monitoring and plan
approvals.; and
WHEREAS, Section 53-81, Hawaii Revised Statutes,
provides that should a redevelopment agency not exist, the
County Council by ordinance shall determine the means by which
the powers of a redevelopment agency shall be exercised.
HE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. Pursuant to the provisions of
Chapter 53, HRS, it is the purpose of this ordinance to
designate the Planning Department as the lead agency in
coordinating the monitoring, enforcing and approvals provided
for in the Kaiko'o Plan, as amended, and the Downtown Hilo
Redevelopment Plan, dated February 1985.
SECTION 2. Chapter 2, Article 7 of the Hawaii County Code
1983, is hereby amended by adding a new section to read as
follows:
"Section Urban Renewal. The Planning Department
is hereby determined to be the lead agency in enabling the
county to directly exercise its powers as provided for in Parts
I and II of Chapter 53, Hawaii Revised Statutes. As the lead
agency, the Planning Department shall delegate the
responsibilities of the Hawaii Redevelopment Agency to the
appropriate departments, commissions and agencies to insure
that the procedures of compliance are adhered to."

SECTION 3. This ordinance shall take effect upon its
approval.
