A BILL FOR AN ORDINANCE AMENDING CHAPTER 9 OF THE HAWAII COUNTY
CODE 1983, RELATING TO ELECTRICITY.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The purpose of this bill is to relieve
the unnecessary requirement that contractors, in addition to
having a license to perform electrical work, under the provisions
of chapter 444 of the Hawaii Revised Statutes, also have a
supervising electrician or a supervising specialty electrician
under his employment in order to be issued a permit to perform
electrical work. The Council finds that if the contractor already
possesses a valid, unexpired, unrevoked license enabling them to
perform electrical work, they should not be required to employ an
additional supervising electrician or supervising specialty
electrician to be issued a electrical permit.
SECTION 2. Chapter 9, section 9-35, of the Hawaii County Code
1983, relating to electricity, is amended to read as follows:
Section 9-35. Persons to whom permit may be issued. A permit
to do electrical work regulated by this chapter may be issued only
to:
(a) A home owner for electrical work on a single family
dwelling regulated by this chapter and used exclusively for living
purposes, including the usual accessory buildings on the same

property, provided that said work be performed by a person
licensed under chapter 448E of the Hawaii Revised Statutes;
provided further that the home owner shall furnish the name and
license number of said person licensed under 448E of the Hawaii
Revised Statutes, at the time of application for the permit. Only
one such permit may be issued to such a home owner, unless the
administrative authority finds that strict application would
result in practical difficulty and hardship and that the granting
of a second permit would not be contrary to the purpose of the
chapter.
(b) A contractor who is licensed under the provisions of
chapter 444 of the Hawaii Revised Statutes, and possesses a valid,
unexpired, unrevoked license which qualifies him to perform
electrical or electrical specialty work [and who has a supervising
electrician or a supervising specialty electrician under his
employmentl.
(c) A supervising electrician or supervising specialty
electrician.
(1) Who is employed as a maintenance electrician by
someone other than a contractor described above; or
(2) Who is donating his services to an eleemosynary
institution for temporary electrical installation; or
(3) Who is employed by the County or State; or
(4) Who is applying for electrical work for his own
dwelling.

SECTION 3. Material to be repealed is bracketed. In printing
this ordinance, the brackets and bracketed material need not be
included.
SECTION 4. This ordinance shall take effect upon its approval.
